AMENDATORY RESOLUTION NO. 85-71
AMENDED RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF BAKERSFIELD CONSENTING TO THE INCLUSION OF THE
LANDS WITHIN THE CITY IN THE PROPOSED URBAN BAKERSFIELD
AREA IMPROVEMENT DISTRICT.
WHEREAS, the Kern County Water Agency is authorized to
establish an improvement district for providing supplemental water
to the Urban Bakersfield Area, and
WHEREAS, the Kern County Water Agency adopted a resolution
on December 10, 1970, declaring its intent to form an improvement
district for the purpose of bringing supplemental water to the
Urban Bakersfield Area, and
WHEREAS, by letter dated May 24, 1971, the City of
Bakersfield approved a plan for delivery of imported water to the
Urban Bakersfield Area by way of a Cross-Valley Canal subject to
more detailed plans for the construction of the canal and partici-
pation thereof, and
WHEREAS, plans have been drawn, cost figures presented
on a joint participation basis, and other data prepared by the
Kern County Water Agency in the implementation of the proposed
Urban Bakersfield Improvement District, and
WHEREAS, Section 99-14.9 of the Kern County Water Agency
Act as amended by Statutes 1968 Chapter 369 provides that the
legislative body of the City of Bakersfield must file a resolution
adopted by a majority vote of the City Council consenting to the
inclusion of lands within the improvement district, and
WHEREAS, the City Council, on November 1, 1971, adopted
Resolution No. 76-71, consenting to said inclusion under specified
conditions and now desires to amend said Resolution.
NOW, THEREFORE BE IT RESOLVED by the City_Council of the
City of Bakersfield that Resolution No. 76-71, adopted on November
1, 1971, is hereby amended to read as follows:
1. That the report entitled

by Walter G. Schulz, Consultant
October, 1971"
is hereby made a part of this Resolution as if fully set forth
herein.
2. That the City of Bakersfield consents to the inclusion
of the lands within the City of Bakersfield in the proposed improve-
ment district provided that the Kern County Water Agency's r.esolution
declaring the improvement district formed states that the project
to be undertaken within the improvement district shall be substan-
tially as described in the Second Supplemental Report referred to
above.

I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at
a regular meeting thereof held on the 2_~h~h day of November, 1971,
by the following vote:
