A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD WHEREBY THE CITY WAIVES THE 90- DAY WAITING PERIOD REQUIRED BY SECTION 73 OF THE STREETS AND HIGHWAYS CODES AND ACCEPTS THE STATE RELINQUISHMENT OF THAT PORTION OF STATE HIGHWAY 178 SUPERSEDED BY RELOCATION (NILES AND MONTEREY STREETS) BETWEEN STOCKTON AND VIRGINIA.STREETS. SECTION 1. WHEREAS: (a) The State of California Business and Transportation Agency, Department of Public Works, Division of Higlhways and the City of Bakersfield entered into an agreement on July 17, 1961, providing for t'he construction of a freeway on State Highway Route 178 (formerly State Highway Route 57) in t'he City of Bakersfield between "~' Street and the east City limit of Bakersfield; and (b) Such freeway has been constructed and traffic has been rerouted thereon; and (c) The existing State Highway Route 178 (Niles and Monterey Streets) between Stockton and Virginia Streets in the City of Bakersfield is now considered "superseded by relocation"; and (d) Said superseded State highway has been placed in a state of good repair; and (e) Said superseded State hig'hway is shown hachured on t'he map labeled EXHIBIT "N' attached hereto which is hereby made a part hereof, and the 'hig'hway so illustrated will properly become part of the City street system. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield, State of California, as follows: (a) The City hereby agrees~nto accept all right, title and interest of the State in and to said superseded State 'highway as t'he same is shown'hachured on EXHIBIT "A" attached 'hereto, and City accepts responsibility for control and maintenance thereof. (In- asmuch as improvement of said superseded State lhighway has been accomplished to t'he satisfaction of the City Director of Public Works, the City of Bakersfield waives the ninety (90) day waiting period required by Section 73 of the Streets and Highways Code for processing such highway relinquishment and City accepts the relinquish- ment upon adoption of the resolution by the California Highway Commission and subsequent recordation thereof.) (b) It is further ordered that the Clerk of the Council shall forthwith forward two certified copies of this resolution to the Division of Highways, P. O.
