HomeMy WebLinkAboutRES NO 60-71RESOLUTION NO. 60-71 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD CERTIFYING TITLE TO THE INTER- SECTIONS WITHIN THE "BAKERSFIELD TOPICS PLAN FOR THE INSTALLATION AND MODIFICATION OF TRAFFIC SIGNALS AND STREET LIGHTING SYSTEMS AT VARIOUS INTERSECTIONS." SECTION 1. WHEREAS: (a) The State of California Division of Highways requires a certificate from the City concerning the title to City roadways which are to receive Federal Funds under the Urban Traffic Operations Program to Increase Capacity and Safety; and (b) It is desired by t'he Council of the City of Bakersfield that the following intersections be improved as an 06-.T.O.P.I.C.S. Project: I(1) 30th Street at H Street~ (2) 20th Street at L Street, (3) California Avenue at H Street, (4) California Avenue at Chester Avenue, (5) Belle Terrace at South Chester Avenue, (6) Ming Avenue at Sout'h H Street, and (7) Ming Avenue at South Chester Avenue'. NOW, THEREFORE, BE IT RESOLVED by the Council of t'he City of Bakersfield, State of California, that the City of Bakersfield does hereby certify that it has good t~le as City to said rights-of-way aforedescribed, and the Mayor is directed to show the City's act by signing and delivering to said Division of Highways the attached certificate. o0o I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the Council of the City of Bakersfield at a regular meeting thereof held on the 9th day of August, 1971, by the following vote: A'Y~S, COUNCILMEN BLEECKER, HEISEY, MEDDERS, REE$; ~ TI-iOMA~, ~ NOES~ COUNCILMEN: ~ .... Project intersections: (1) 30th Street at H Street, (2) 20th Street at L Street, (3) California Avenue at H Street, (4) California Avenue at Chester Avenue, (5) Belle Terrace at South Chester Avenue, (6) Ming Avenue at South H Street, and (7) Ming Avenue at South Chester Avenue. That all required rights-of-way for construction of these projects have been acquired by the City of Bakersfield by appropriate legal instrument (grant deeds, subdivision dedication); and~the following is 'hereby certified: 1. Status of Right-of--Way Acquisitions. The entire rights-of-way for these projects were acquired by grant deed or subdivision dedication. 2. Status of Affected Railroad Facilities. There are no railroad facilities within the limits of these projects. 3. Designated Material Sites· There are no material sites designated for these projects. projects. projects. Compliance with the provisions of IM-80-1-68 was not required for these projects. The City of Bakersfield agrees to hold the State of California harmless from any liability which may result in tlhe event the rights-of-way are not clear as certified· If it'he State is named in a damage suit, as a result of the rights-of-way not being clear as certified, tlhe City of Bakersfield agrees that, at the request of the State, it will assume full responsibility for the conduct of t'he defense or provide such assistance as the State may require and will 'pay any judgments issued against the State and all costs in connection. with the defense· CITY OF BAKERSF~E.~ 7~'
