HomeMy WebLinkAboutRES NO 42-71RESOLUTION NO. 42-71 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD ORDERING THE VACATION OF SEWER EASEMENT NO. 3, BLOCK 2, CALIFORNIA AVENUE PARK TRACT NO. 2, IN THE CITY OF BAKERSFIELD. WHEREAS, on the 5th day of April, 1971, ~he Council of the City of Bakersfield, pursuant to the provisions of the "Public Service Easements Vacation Law," being SeCtions 50430 to 50445, inclusive, of the Government Code of the State of California, passed and adopted its Resolution of Intention No. 863 declaring its intention to order'the vacation of a sewer easement in Block 2, California Avenue Park Tract No. 2, situate in the City of Bakersfield, County of Kern, State of California; and WHEREAS, said Council did fix a time and place for hearing all persons interested in or objecting to said proposed vacation, which hearing was held on the 3rd day of May, 1971, after Notices were duly published and posted as required by law, NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED AND RESOLVED by the City Council of the Cityof Bakersfield, State of California, as follows: 1. That said sewer easement, hereinafter described, is unnecessary for present or prospective public use. Said easement, situate in the City of Bakersfield, County of Kern, State of California, is described as follows: An easement ten (10) feet in width, lying five (5) feet on either side of the follow- ing described center lines: Beginning at the southwest corner of Lot 1, Block 2,-"C~lifornia-Avenue' Park Traet.N0~ recorded in Map Book 3, at page.ll5, Records of Kern County, California; thence northerly along the westerly lines of Lots 1 to 11, both inclusive, of said Block 2 to the north- west corner of said Lot 11. 2. That said sewer easement be and the same is hereby vacated and abandoned, subject to and in conformity with said Resolution of Intention No. 86'3. Reference to said Resolution of Intention is hereby made for further particulars. 3. That the Planning Commission of the City of Bakersfield approved the vacation of said easement at its regular meeting on April 7, 1971. 4. That the City Clerk shall certify to the passage of this Resolution, and shall cause a certified copy thereof, attested by the Clerk under the seal of the City, to be recorded in the office of the County Recorder of Kern County, California. o0o I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the Council of the City of Bakersfield at a regular meeting thereof held on the 3rd day of May, 1971, by the following vote: AYES: COUNCILMEN B~L~L~f~, HEISEY, MEDDERS, REES, RUCKER, THOMAS, WHITTEMORE NOES: COUNCILMEN: ABSTAINING COUNCILMEN: of the Council of the C~ty of Bakersf~eld APPROVED: CITY ATTORNE,Y7'
