RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD, CALIFORNIA, MAKING DETERMINA-
TIONS AND CONFIRMING ASSESSMENT OF THE COST
OF DOING THE WORK ORDERED PURSUANT TO
RESOLUTION OF INTENTION NO. 854.
WHEREAS, the Superintendent of Streets of the City of
Bakersfield, California, has heretofore, on the 2nd day of April,
1971, made and filed in the office of the City Clerk of said City,
an assessment and diagram for that certain work and improvements
in the City of Bakersfield, done under and pursuant to the Improve-
ment Act~of 1911 (commencing at Section 5000 Streets and Highways
Code), and Resolution of Intention No. 854; and
WHEREAS, after the filing of said assessment and diagram,
the City Clerk has given Notice of the filing of said assessment
and of the time and place set for hearing thereon by the City
Council, and said City Clerk having executed an affidavit setting
forth the time and manner of mailing, posting, and publishing Of
said notices; and
WHEREAS, at the time and place stated in said Notice, a
hearing was duly held by the City Council, and said assessment and
diagram were presented and considered, and all written appeals,
protests and objections, if any, were duly presented, read, heard
and considered and all persons desiring to be heard thereon, were
heard in respect to any matters relating to said work or improve-
ment or to any act or determination of the Superintendent of Streets
in relation thereto, or to the contract for said work or the perform-
ance thereof, or to the omissions or inclusions of any portions of
said work in said contract, or to the correcthess of said assessments
or said'diagram, or to any ~ther'act, determination or proceedings
of said Superintendent of Streets, or to any matter relating to said
work, the assessment district or the proceedings therefor, and said
City Council having received evidence relating to the foregoing.
NOW, THEREFORE, the City Council of the City of
Bakersfield, California, DOES HEREBY FIND, RESOLVE, DETERMINE AND
ORDER AS FOLLOWS:
SECTION 1.
Said hearing has been duly held, and Notice thereof has
been given according to law.
SECTION 2.
All protests and objections, written and oral, if any,
made or filed with respect to said assessment, diagram and other
matters heard by the City Council~ be and the same are hereby
overruled and denied.
SECTION 3.
Each and every step in the proceedings, prior to and
including said hearing, has been duly and regularly taken, and this
City Council is satisfied with the correctness of the assessment,
the diagram, the proceedings and all matters relating thereto, and
does hereby confirm said proceedings and said assessments and dia-
grams.
SECTION 4.
That pursuant to Section 3114 of the Streets and Highways
Cbde, the City Clerk is hereby ordered and shall c~use to be
recorded in the office of the Kern County Recorder a copy of the
assessment, diagram and ~otice of assessment for Public Improvement
District No. 854.

I HERE'BY CERTIFY that the foregoing Resolution was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on the 26th day of April, 1971, by the follow-
ing vote:
