A RESOLUTION OF THE COUNCIL OF THE CITY
OF BAKERSFIELD TO INCLUDE A LIMITED
PORTABLE CONCRETE BATCH PLANT TO THE
LIST OF PERMITTED USES' IN AN M-1 (LIGHT
MANUFACTURING) ZONE, AND THAT ANY CONCRETE
BATCH PLANT BE REQUIRED TO FIRST OBTAIN
A WRITTEN PERMIT FROM THE AIR POLLUTION
CONTROL BOARD BEFORE CONSTRUCTION.
WHEREAS, the Planning Commission of the City of Bakersfield,
did, on the 7th day of April, 1971, pass a resolution finding that
the inclusion of an additional use, to wit: a limited portable
concrete batch plant in an M-1 (Light Manufacturing) Zone, would
not be more obnoxious or detrimental to the welfare of the co~m,~unity
than the permitted uses specifically mentioned in Chapter 17.31 of
Title Seventeen of the Bakersfield Municipal Code, and
WHEREAS, the Council of the City of Bakersfield has con-
sidered said matter and does find that the inclusion of said
additional use in said zone will not be more obnoxious or detrimental
to the welfare of the community than the permitted uses specifically
mentioned in Chapter 17.31 of Title Seventeen of the BakersflOrid
Municipal Code.
NOW, THEREFORE, pursuant to Section 17.52.040 of Title
Seventeen of the Bakersfield Municipal Code, the Council of said
City does HEREBY RESOLVE that the additional use, to wit: a
limited portable concrete batch plant, be and the same is hereby
included as a specifically permitted use in an M-1 (Light Manufac-
turing) Zone.

I HEREBY CERTIFY that the foregoing Resolution was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on the 19th day of April, 1971, by the following
vote:

OF THE CITY OF BAKERSFIELD
A RESOLUTION OF THE PLANNING COM-
MISSION OF THE CITY OF BAKERSFIELD
RECOMMENDING A LIMITED PORTABLE
CONCRETE BULK PLANT AS A PERMITTED
USE IN AN M-1 (LIGHT MANUFACTURING)
ZONE.
WHEREAS, Title Seventeen, Zoning Regulations, of the BakePs~eld
Municipal Code does not list a pontable concnete bulk plant as a penmilled
use in any zone;
and
WHEREAS, a nequest to penraft the openatton oF a limited poPtable
conchere bulk plant in an M-1 (Light ManuFactuning) Zone has been neceived
by the Planning Commission;
and
WHEREAS, the Planning Commission has considePed said Pequest
and at its Pegulan meeting held ApPil 7, 1971, made its Pecommendations
and Findings that a limited poPtable concPete bulk plant would not be mope
obnoxious on detntmental to the weftaPe of the community than the penmilled
uses specifically mentioned tn Chapten 17.81 of Title Seventeen of the
BakensField Municipal Code;
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COM-
MISSION OF THE CITY OF BAKERSFIELD that punsuant to Section
17.52. 040 of Title Seventeen oF the Bakensfield Municipal Code, it is the
opinion oF said Planning Commission that the inclusion oF an additional
use, to-wit:
