RESOLUTION OF INTENTION TO INCLUDE WITHIN THE
GREATER BAKERSFIELD SEPARATION OF GRADE DISTRICT
A PORTION OF CERTAIN TERRITORY DESIGNATED AS
"AUBURN NO.2", AND SETTING THE TIME AND PLACE
FOR HEARING OBJECTIONS TO THE INCLUSION OF SAID
TERRITORY WITHIN SAID DISTRICT.

WHEREAS, proceedings have been commenced for the
annexation of certain unincorporated territory, designated as
"Auburn No.2", to the City of Bakersfield, and
WHEREAS, a portion of said territory lies outside the
Greater Bakersfield Separation of Grade District, and
WHEREAS, Section 8290 of the Streets and Highways Code
of the State of California, provides that the unincorporated
territory of a county which was not included within a separation of
grade district at the time of the formation of such district, and
which subsequent to the formation of such district is annexed to
or otherwise included within a city which is a part of such district,
shall immediately upon such annexation to such city be included

within the district and shall thereafter become a part of the
district to the same extent as such city; except such portion or
portions thereof which the City Council has determined, will not
be benefited by inclusion in the district.
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Bakersfield, as follows:
1. That a description of the unincorporated territory
described in the annexation proceedings, is as follows:
A parcel of land situate in the County of Kern, State of California,
and being a portion of Sections 13 and 24, T 29 S, R 28 E, M.D.B. & M.
Being at the point of intersection of the east line of the W 1/2 of the
SE 1/4 of the SW 1/4 and the north line of the E 1/2 of the SE 1/4
of the SW 1/4 of said Section 13, sald point being on the Corporate
Boundary of the City of Bakersfield as described by Ordinance No. 1766,
New Series;

Thence (1) easterly along the last-named north line to intersect
the east line of SW 1/4 of said Section 13;
Thence (2) continuing easterly along the north line of the S 1/2 of
the SE 1/4 of said Section 13, to intersect on the west line of the
east 55 ft. of said Section 13;
Thence (3) southerly along the last-named west line to intersect the
south line of said Section 13;
Thence (4) S 0035'11"W along the west line of the east 55 feet of
said Section 24, 120.96 feet to a point on the northerly right~of-
way of Route 06-KER-178 (State Route 178 Freeway);

to the northwest corner of the NE 1/4 of said Section 24;
Thence (11) westerly along the north line of said Section 24 to inter-
sect the west line of the east 523.50 feet of the NW 1/4 of said
Section 24, said intersection being a point on the Corporate
Boundary as defined by Ordinance No. 1766, New Series;
Thence (12) northerly, westerly and northerly along the last-named
Corporate Boundary to the point of beginning.
2. That unless any portion shall be excluded by the
City Council, all portions of said unincorporated territory shall
upon annexation to the City of Bakersfield be included within the
Greater Bakersfield Separation of Grade District.
3. That Monday, the 18th day of January, 1971, at the
hour of 8:00 P. M., in the Council Chambers of the City Hall, 1501
Truxtun Avenue, Bakersfield, is the time when and the place where,
objections to inclusion within the district will be heard.

I HEREBY CERTIFY that the foregoing Resolution was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on the 7th day of December, 1970, by the
following vote:
