A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD ORDERING THE VACATION.OF A
PUBLIC SERVICE EASEMENT IN LOT 40, TRACT
3334, CITY OF BAKERSFIELD.
WHEREAS, on the 9th day of November, 1970, the Council of
the City of Bakersfield, pursuant to the provisions of the "Public
Service Easements Vacation Law", being Sections 50430 to 50445,
inclusive, of the Government Code of the State of California,
passed and adopted its Resolution of Intention No. 861, declaring
its intention to Order the vacation of a public service easement,
also referred to herein as a public utilities easement, in Tract
3334, situate within the City of Bakersfield, County of Kern, State
of California, and
WHEREAS, said Council did fix a time and place for hearing
all persons interested in or objecting to said proposed vacation,
which said. hearing was held on the 30th day of November, 1970, after
notices were 'duly published and posted as required by law, and
WHEREAS, this Council'after duly considering the matter,
does hereby find and resolve as follows:
1. That said public service easement also referred to
herein as public utilities easement, hereinafter described, is
unnecessary for present or prospective public use:
The west three (3.00) feet of the east ten (10.00)
feet of Lot 40 of Tract 3334, excepting the southerly
five (5.00) feet, as said Tract is shown on that map
filed November 28, 1969 in the Office of the County
Recorder of Kern County, in Book 8 of maps at pages
148 and 149.
2. That said public service easement be and the same is
hereby vacated and abandoned for public service easement purposes,
subject to and in conformity with said Resolution of Intention No.
861. Reference to said Resolution of Intention is hereby made for
further particulars.
3. The City Clerk shall certify to the passage of this
Resolution, and shall cause a certified copy thereof, attested by
the Clerk under the seal of the City, to be recorded in the office
of the County Recorder of Kern County, California.

I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at a
regular meeting thereof held on the 30th day of November, 1970, by
the following vote:
