HomeMy WebLinkAboutRES NO 49-80RESOLUTION NO. 49-80 RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD DECLARING IT HAS REVIEWED, EVALUATED AND CONSIDERED THE INFORMATION CONTAINED IN THE FINAL EIR FOR A PROPOSED STATE COLLEGE AREA GENERAL PLAN AMENDMENT, MAKING FINDINGS AND CERTIFYING THAT SAID FINAL EIR HAS BEEN COMPLETED IN COMPLIANCE WITH THE CALIFORNIA ENVIRONMENTAL QUALITY ACT, THE STATE EIR GUIDELINES AND CITY RESOLUTION NO. 39-78. WHEREAS, it is proposed that certain Land Use Amendments be made to the Bakersfield Metropolitan Area General Plan (BMAGP) Land Use Element within the 19 square mile area known as the State College Area General Plan; and WHEREAS, the project sponsors are proposing the follow- ing specific amendments to various undeveloped acreage: 1. (a) 80 acres adjacent to the South boundary of the State College from High Density Residential use (16-45 housing units per gross acre) to Professional Offices, (b) 55 acres North of Stockdale Highway near the State College from Open Space to Professional Offices, (a) 160 acres between the State College and Gosford Road and 40 acres between the State College and Old River Road from High Density Residential to Medium Density Residential use (6-15 housing units per gross acre), (b) 155 acres between the Arvin-Edison Canal and Gosford Road from Open Space to Medium Density Residential, (c) Relocation of a neighborhood shopping center site approximately one-half mile West to the Stockdale Highway/ Buena Vista Road intersection, 60 acres at Gosford Road and White Lane from Com- mercial to Medium Density Residential, 20 acres at New Stine Road and Planz Road from Commercial to Low Density Residential Use (2-5 housing units per gross acre), 30 acres adjacent to Kapral Way along Planz R~ad from Open Space to Low Density Residential, 10 acres at Old River Road and Pacheco Road from Low Density Residential to Commercial, and 95 acres between the Truxtun Avenue extension and the Carrier Canal, North of the Mohawk Street extension from Open Space to Industrial, 30 acres between the 'Truxtun Avenue'extension and the Carrier Canal, Southwest of the Mohawk Street extension from Open Space to Low Density Residential, WHEREAS, a Draft Master Environmental' Impact Report on said project was prepared by the City of Bakersfield under contract with a consultant, circulated and distributed in accordance with the requirement of law.and applicable regulations, the distribu- tion list being included in the Final Master Environmental Impact Report; and WHEREAS, public and/or private agencies and/or individuals submitted written comments on the Draft Master Environmental Impact Report, as listed in the Final Master Environmental Impact Report; and WHEREAS, a duly noticed public hearing was held and conducted by and before the City of Bakersfield Planning Commission in accordance with the procedures required by City Resolution 39-78, on April 2, 1980, at which hearing the public was entitled to comment upon the Draft Master Environmental Impact Report; and WHEREAS, the City has responded in writing to all significant points raised by the public and private agencies and individuals in the review and public hearing process, and the Final Master Environmental Impact Report, consisting of the Draft Master Environmental Impact Report, comments and recommendations received on the Draft Master Environmental Impact Report, including a response from CALTRANS, a State of California agency, received too late for inclusion into the document text, a list of persons or organizations and public agencies commenting on the Draft and the responses of the City as aforesaid has been completed by the Development Services Department and placed on the agenda of the Adjourned Meeting of the Planning Commission on May 6, 1980, for evaluation and consideration by said Commission which was continued to a Special Meeting of the Planning Commission on June 5, 1980; and WHEREAS, at said Special Meeting on June 5, 1980, the Planning Commission evaluated and considered the Final Master Environmental Impact Report, including late comments and by its Resolution No. 20-80, adopted June 5, 1980, recommended to the City Council that the Final EIR be certified as completed in compliance with the California Environmental Quality Act, the State EIR Guidelines and Cityof Bakersfield Resolution No. 39-78. NOW, THEREFORE, THE CITY COUNCIL HEREBY DETERMINES, FINDS AND RESOLVES AS FOLLOWS: 1. The above recitals are true and correct. 2. That the Final MEIR dated April 1980, including late comment from CALTRANS and City response as an appended document, has been reviewed, evaluated and considered by the City Council. 3. That the said Final MEIR is an accurate and objective discussion of the proposed project and adequately discusses and describes the environmental considerations and mitigation measures except for'the inclusion of a geologica~ and soils investigation of any future urban development project proposed within the River- wash - Carrizo soil association as defined by the U. S. Department of Agriculture Soil Conservation Service in the 1967 Soil Report for Kern County and any future Soil Conservation Service soils investigation within the project area for which the following mitigationis adopted as a condition to final approval of any development within the above soil association such a geologic and soils investigation be made and a report prepared addressing the advisability of specific site development and detailing the appropriatemitigation that would allow construction and occupancy under reasonable assurance that health, safety and welfare interests of all participants are met, consistent with approved development elsewhere inthe City of Bakersfield. 4. That the various alternatives tothe project, includ- ing "no project" have been considered in. the Final MEIR. 5. That the Final EIR with appended material and with the above-stated mitigation is an accurate and objective discussion of the proposed project and adequately discusses and describes the environmental considerations, alternatives and mitigation measures which need to be considered prior to the approval of the proposed project. 6.
