A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AUTHORIZING THE FILING OF AN
APPLICATION WITH THE KERN COUNTY COUNCIL
OF GOVERNMENTS FOR CLAIM OF TRANSPORTATION
DEVELOPMENT ACT FUNDS FOR EXCLUSIVE USE OF
PEDESTRIANS AND BICYCLES.
WHEREAS, The Transportation Development Act of 1971 provides
for the disbursement of funds from the Local Transportation Fund held in
trust by the Kern County Auditor-Controller for use by eligible claimants
for the purpose authorized by Article 3, Section 99233.3; and
WHEREAS, an eligible claimant wishing to claim such Local
Transportation Funds must file its application with the Kern County Council
of Governments pursuant to the rules and regulations that have been adopted
by the Secretary of the Business and Transportation Agency of the State of
California in accordance with the provisions of the aforementioned legislation;
and
WHEREAS, the City of Bakersfield and the County of Kern desire
to cooperate in the application for funds and the construction of a facility
for pedestrians and bicycles within the urbanized area of Bakersfield; and
WHEREAS, funds from the Local Transportation fund will be used
to construct and maintain facilities for the exclusive use of pedestrians
and bicycles to be located along the Kern River between Cal State Bakersfield
and Hart Park and also to Bakersfield College,
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Bakersfield as follows:
1. That the Director of Public Works is authorized to execute
and file a joint claim with the County of Kern pursuant to the terms of the
Transportation Development Act of 1971, as amended, and pursuant to applicable
rules and regulations promulgated thereunder, together with all necessary
supporting documents, with the Kern County Council of Governments for
Transportation Development Act monies
2. That a copy of this resolution be transmitted to the Kern
County Planning Department, Kern County Public Works and to the Kern County
Council of Governments in conjunction with the filing of the claim; and the
Kern County Council of Governments be requested to concur in these findings
and grant funds as specified on the Article 3 claim.
I HEREBY CERTIFY that the foregoing Resolution was passed and
adopted by the Council of the City of Bakersfield at a regular meeting
thereof held on the 2nd day of July, 1980, by the following vote:
