HomeMy WebLinkAboutRES NO 90-79CITY COUNCIL OF TItE CITY Oi) BAKEI~.SF1ELD I'VESOLUTION NO. 90-79 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAKERSFIELD ADOPTING THE FINAL SUBSEQUENT ENVIRONMENTAL IMPACT REPORT FOIl TIlE DOWNTOWN BAKERSFIELD REDEVELOPMENT PROJECT, AND MAKING CERTAIN FINDINGS WITH RESPECT TO THE ENVIRON MENTAL IM PACT OF SAID PROJECT WHEREAS, a Draft Subsequent Environmental Impact Report for the Downtown Bakersfield -Redevelopnmnt Project, as proposed to be amended, has heretofore been prepared and circulated for comment by the Bakersfield Redevelopment Agency ("Agency") pursuant to the California Environmental Quality Act of 1970, as amended (GEQA), and State and Agency regulations and guidelines adopted pursuant thereto; and WHEREAS, a duly noticed public hearing was held on said Report by the Agency on October 23, i979, at which time all persons were given an opportunity to be h~ard; and WitEREAS, a Final Subsequent En.vironmental hapact Report for the Project w~is prepared and certified by the Agency pursuant to said statute, regulations and guidelines, which is contained in two d0euments apd includes 'and incorporates the Draft SubSequent Environmental hapact P, eport (hereinafter referred to as Document 1); .comments and recommendations received on the Draft Subsequent Environmental Impact Report at public hearing and by written communication, a list of persons, organizations, and public agencies eommenting on the Draft Subsequent Environmental Impact Report, and Redevelopment Agency responses to significant environmental points raised in the review and consultation process (heroinafter' referred to collectively as Document 2}; and WHEREAS, pursuant to said statute, regulations and guidelines, the Final Subsequent Environmental Impact Report for the Downtown Bakersfield Redevelopmerit Project was transmitted by the Redevelopment Agency to this City Council; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAKERSFIELD AS FOLLOWS: 1. The City Council hereby certifies that the Final Subsequent Environmental Impact Report for the Downtown 13akersfield Redevelopmeat Project, as proposed to be amended, has been prepared and completed in compliance with the California Environmental Quality Act of 1970, as amendted, and with State and Agency regulations and guidelines adopted pursuant thereto. 2. The City Coun6il hereby further certifies that the information contained in the Final Subsequent Environmental hr~paet Report for said Project, as proposed to be amended, has been reviewed and copsidereal by tile Members of the City Council. 3. The City Council hereby finds and determines as follows with respect to tim adverse enviro'nmental impacts detailed in the Final Subsequent Environmental hnpaet Report: bo That the adverse environmental impacts of the Project, as proposed to be amended, set forth in the Final Subsequent Environmental Impact Report, including those raised in comments to the Draft Subsequent Environmental Impact Report, have been considered and recognized by the City Cormell. That none of said adverse impacts will have a significant effect, or result in a substantial, or potentially substantial, adverse change in the environment. That based upon the information contained in the Amended Redevelopment Plan, as proposed to be amended, for the Project, and in the Final Subsequent Environmental impact Report, ineluding but not limited to the information contained in Sections 3.21-3.28 and Seeti0ns 3.31-3.37 (pp. 3-1 throught 3-89 of Doeument l) and Sections 2.1-2.14 and Sections 3.1-3..5 of Document 2, thereof, the City Council hereby finds and determines that changes or slternations have been required in, or incorporated' into, the Project which mitigate or avoid each of the adverse environmental impacts identified in Sections 3.22-3.24, 3.27-3.28, 3.31-3.32, 3.341, 3.352, 3.354, 3.356, 3.359-3.361, 3.363-3.364, 3.366, 3.37 of Document l, and Sections 2.0 and 3.0 of Document 2. That as to the adverse environmental impacts of the Project listed in Section 4.1 of Document 1 which cannot be entirely mitigated or avoided if the Project is implemented, the City Council hereby finds and determines that the specific economic, social, financial, environmental and other considerations set forth in the Final Subsequent Environmental Impact Report, including but not limited to those considerations set forth in Section 1.1 and 1.3 of Document l, make infeasible the mitigation measures and project alternatives identified in the .Final Subsequent Environmental Impact Report with respect to each such adverse environmental.impact which cannot be entirely mitigated or avoided. 4. The City Council finds and determines that said Project, as proposed to be amended, will not have a significant effect or result in a substantial, or potentially substantial, adverse change in the environment.
