HomeMy WebLinkAboutRES NO 82-79RESOLUTION NO. 82-79 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD ORDERING THE VACATION OF A ROAD EASEMENT NORTH OF STATE ROUTE 178, IN THE CITY OF BAKERSFIELD. WHEREAS, on the 10th day of October, 1979, the Council of the City of Bakersfield, pursuant to the provisions of the "Street Vacation Act of 1941," being Division 9, Part 3, of the Streets and Highways Code of the State of California, passed and adopted its Resolution of Intention No. 945 declaring its intention to order the vacation of a road easement north of State Route 178, in the City of Bakersfield, County of Kern, State of California; and WHEREAS, said Council did fix a time and place for hearing all persons interested in or objecting to said proposed vacation which said hearing was held on the 31st day of October, 1979, after notices were duly posted as required by law; and WHEREAS, this Council after duly considering the matter, does hereby find and resolve as follows: 1. That the road easement north of State Route 178, in the City of Bakersfield, County of Kern, State. of California, more particularly described in Exhibit "A" attached hereto and made a part hereof, is unnecessary for present or prospective public street purposes. 2. That said road easement north of State Route 178, be and the same is hereby closed up, vacated and abandoned for public'street purposes,.subject to and in conformity with the reservations and exceptions contained in and contemplated by said Resolution of Intention No. 945. Reference to said Resolution of Intention is hereby made for further particulars. 3. That the City Clerk shall certify to the passage of this Resolution and shall cause a certified copy hereof, attested by the Clerk under the seal of the City, to be recorded in the office of the County Recorder of the County of Kern, California. o0o I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the Council of the City of Bakersfield at a regular meeting thereof held on the 31st day of October, 1979, by the follow- ing vote: AYES: COUNCILMEN ~~RISTENSEN, MEANS, MILLER, PAYNE, RATTY, STRONG NOES: COUNCILMEN ASS"~N~: cou~,'~.~:_. Bakers ield EXHIBIT "A" A strip of land 20 feet in width situated in the City of Bakersfield, County of Kern, State of California, being a portion of Sections 3 and 10, T29S, R29E, M.D.B. & M., the centerline of which is more particularly described as follows: Commencing at a. point in the west line orsaid Section 3 from which point the northwest corner of said Section 3 bears North 1~ 07' East 3152 feet, 'said point also being the southwest corner of Parcel'] as described in Book 71, Page 320, of the Official Records in the Office of the Kern COunty Recorder; thence South 89° 51' East 2045 feet along the'south line of the last named Parcel 1 to the True Point of Beginning for this description; THENCE (1) South 14° 10' East 2000 feet; THENCE (2) South 9° 45' East 600 feet; THENCE (3) South S° 35' East 1200 feet; THENCE (4) South 40° West 274 feet to the end point of'this description.
