HomeMy WebLinkAboutRES NO 79-79RESOLUTION NO." 79-79 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD MAKING FINDINGS, ADOPTION OF NEGATIVE DECLARATIONS AND DENYING APPROVAL OF SEGMENT 1 OF PROPOSED AMENDMENT TO LAND USE ELEMENT OF BAKERSFIELD METROPOLITAN AREA GENERAL PLAN AND APPROVING SEGMENTS 2 AND 3 OF PROPOSED AMENDMENT. WHEREAS, this Council referred a proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan, consisting of Segments 1, 2, and 3, to the Planning Commission, Which segments are described as follows: Segment 1: Change from low-density residential to pro- fessional office on approximately .16 acre of land located on the northwest corner of Truxtun Avenue and Olive Street. Segment 2: Incorporate the land use designation of commercial and professional office for approximately 2.78 acres of land located between 33d and 34th Streets, and east of San Dimas Street, as shown on map. Segment 3: Incorporate the land use designation of commercial on approximately 4.3 acres of land located north of, and adjacent to an 8-acre parcel zoned C-2, at the ~ortheast corner of White Lane and Hughes Lane as shown on map, subject to conditions set forth herein; and WHEREAS, on September 5, 1979, the Planning Commission, by Resolution No. 54-79, approved and adopted Negative Declarations as to each segment described above; and WHEREAS, the Planning Commission, in accordance with the provisions of Section 65351 of the Government Code, conducted a public hearing, on the above-described amendment; and WHEREAS, as to Segment 1 on September 5, 1979, by Resolution No. 54-79, the Planning Commission disapproved and recommended disapproval and denial by the City Council; and WHEREAS, as to Segment 2, on September 5,. 1979, by Resolution No. 54-79, the Planning Commission approved and recommended approval and adoption by the City. Council; and WHEREAS, as to Segment 3, on September 5, 1979, by Resolution No. 54-79, the Planning Commission approved and recommended approval and adoption by 'the City Council, subject to the conditions stated in said Resolution; and .WHEREAS, this Council, in accordance with the provisions of Section 65355 of the Government Code, conducted and held a public hearingon the above-described proposed amendment to the Land Use Elementof the Bakersfield~Metropolitan Area General Plan, consisting of the three (3) segments as aforesaid. NOW, THEREFOREI, IT IS HEREBY FOUND, DETERMINED, and RESOLVED AS FOLLOWS: 1. That the proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area of the General Plan, consist- ing of three (3) segments described herein could not have a signifi- cant effect on the environment. 2. That the Negative Declaration as to Segment 1 is hereby approved and adopted. 3. That the Negative Declaration as to Segment 2 is hereby approved and adopted. 4. That the Negative Declaration as to Segment 3 is hereby approved and adopted. 5. That as to Segment 1 of proposed amendment to the Land Use Element, constituting a change from low-density residential to professional office on approximately .16 acre of land located on ~the northwest c~rner of TruxtUn Avenue and OliVe ~tree~_the Council disapproves and denies.such amendment. 6. That as to Segment 2 ofproposed amendment to the Land Use Element, constituting the incorporation~ofthe land use designation of commercial and professional office for approximately 2.78 acres of land located between 33d and34th Streets, and east of San Dimas Street, as shown on map, the Council approves and adopts such amendment. 7. That as to Segment 3 of proposed amendment to the Land Use Element, constituting an incorporation of the land use designation of commercial on approximately 4.3 acres located north of, and adjacent to an 8-acre parcel zoned C-2 at the northeast corner of White Lane and Hughes Lane, as shown on map, the Council approves and adopts such amendment, subject to the following conditions: · (a) -The property to be developed under Planned Com- mercial.Development Zoning and in conjunction with existing C-2 zoned property to the south as one planned shopping complex. (b) Prohibit access and construct a six-foot, decora- tive, masonry wall with landscaped strip between sidewalk and wall, along Teal Street, and along Hughes Lane between Teal Street and the south boundary of the tract on the west side of ~ughes Lane; or provide landscaped berm for said area, berm to be approved by the Planning.Commision. (c) Prohibit uses such as fast-food restaurants and recreational, along Hughes Lane frontage between Teal Street and the south boundary of tract on the west side of Hughes Lane. o0o I HEREBY CERTIFY that the foregoing Resolution was passed and,adopted by the Council of the City'of Bakersfield at a regular meeting thereof held on the 10th day of October, 1979, by the follow- ing vote: NOES: I ' , ABSTAINING: COUNCILIv~EN: ' CITY C lerk of the ,~, ....."
