A RESOLUTION OF THE PLANNING COmmiSSION OF THE
CITY OF BAKERSFIELD MAKING FINDINGS, ADOPTION
OF NEGATIVE DECLARATIONS AND DENYING APPROVAL
OF SEGMENT 1 OF PROPOSED AMENDMENT AND APPROVING
SEGMENTS 2 AND '3 OF PROPOSED AMENDMENT TO LAND
USE ELF~IENT OF BAKERSFIELD METROPOLITAN AREA
GENERAL PLAN AND TRANSMITTAL OF REPORT TO CITY
COUNCIL.
WHEREAS, the City Council referred a proposed amendment
to the Land Use Element of the Bakersfield Metropolitan Area
General Plan consisting of Segments 1, 2 and 3, described as
follows:
Segment 1: Change from low-density residential to pro-
fessional office on approximately o16 acre of land located on the
northwest corner of Truxtun Avenue and Olive Street. ~
Segment 2: Incorporate the land use' designation of
commercial and professional office for approximately 2.78 acres

/commercial on approximately 4~.!3 acres of land located north of,
=/-- a~nd__~dj_~cent to an 8-acresparcel zoned C-2, at the northeast corner
of White Lane and Hughes Lane as shown on map, subject to conditions
set forth herein; and
WHEREAS, for each of the segments described above, an
Initial Study was conducted and it was determined that for each
segment the proposed projects could not have a significant effect
on t~e environment and a Negative Declaration was prepared for each
of such segments; and
WHEREAS, the law and regulations relating to the prepara-
tion and adoption'·of Negative Declarations as set forth in CEQA, the
State EIR Guidelines and City of Bakersfield Resolution No. 39-78
has been duly followed by the City staff and the Planning Commis-
sion; and
WHEREAS, the Planning COmmission, in accordance with
the provisions of SeCtion 65351 of the Government Code,' conducted
and held a public hearing continued from August t5, 1979, to
September 5, 19'79, on the above-described proposed amendment to the
Land Use Element of the Bakersfield Metropolitan Area General Plan,
consisting of the three segments as aforesaid, notice of the time,
date and place of hearing having been duly given at least ten (10.)
calendar days before said hearing.
NOW, THEREFORE, IT IS HEREBY FOUND AND RESOLVED AS 3OLLOWS:
'l. That the proposed amendment to the Land Use Element
of the Bakersfield Metropolitan Area of the General Plan, consist-
ing of three (3) segments described herein could not have a signifi-

'2. That .the Negative Declaration'as to Segment 1 is
hereby approved and adopted.
3. That the Negative Declaration as to Segment 2 is
hereby approved and adopted.
4. 'That the Negative Declaration as to Segment 3 is
hereby approved and adopted ...............
5. That as to Segment 1 of proposed amendment to the
Land Use Element, constituting. a change from low-density residential
to professional office on approximately .16 acre of land located on
the northwest corner of Truxtun Avenue and Olive Street, the Plan-
ning Commission hereby disapproves and denies and recommends dis-
approval and'denial by the City Council.
6.' 'That as to Segment 2 of proposed amendment to the
Land Use.Element, constituting the incorporation of the land use
designation of commercial and professional office for approxi-
mately 2.78 acres of land located between 33d 'and 34th Streets,
and east of San Dimas Street, as shown on.map, the Planning Com-
mission hereby approves and recommends approval and adoption by the
City Council.
7. That as to Segment 3 of proposed amendment to the'
Land Use Element, constituting an incorporation of the land use
designation of commercial on approximately 4.3 acres located north
of, and adjacent to an 8-acre parcel zoned C-2 at the northeast
corner of White Lane and Hughes Lane, as shown~on map, the Planning
Commission hereby approves and recommends approval and adoption by
the City Council, subject to the following conditions:
(a) The property to be developed under Planned Com-'
mercial 'Development Zoning and in conjunction with existing C~2
zoned property to the south ·as one planned shopping complex.
(b) Prohibit access and construct a six-foot, decora-
tive, masonry wall with landscaped strip between sidewalk and wall,
along Teal Street, and along Hughes Lane between Teal Street and
the south boundary of the tract on the west side of Hughes Lane; or
provide landscaped berm'for said area, berm to be approved by the
Planning Commision.
(c)· Prohibit uses such as fast-food restaurants and
recreational, along Hughes Lane frontage between Teal· Street and

the south boundary of tract on the west side of Hughes Lane.
8. That the proposed amendment to the Land Use Element,
consisting of the three (3) segments· above described, the maps
recommended for adoption, and all the papers relevant thereto,
constituting the report of the Planning Commission required by
Section 65356.1 of the Government Code, shall be transmitted by the
Secretary of the Planning Commission to the City Council, for such
action as the .Council shall determine.
~·· WE HEREBY CERTIFY that the foregoing resolution was
passed and adopted by the Planning Commission of the City·of
Bakersfield at a regular meeting thereof held on the 5th day of
September, 1979, by the following roll call vote:
