A RESOLUTION OF THE-COUNCIL OF THE CITY OF
BAKERSFIELD AUTHORIZING THE MAYOR TO EXECUTE
AN AGREEMENT WITH THE MUNICIPAL COURT FOR
WITHHOLDING PROCESSING COSTS AND RECOMMENDING
BAIL SCHEDULE FOR PARKING VIOLATIONS.
WHEREAS, the bail schedule for parking fines has
not been adjusted since 1968; and
WHEREAS, the cost of enforcement of parking violations
has substantially increased during the last ten years; and
WHEREAS, the costs incurred by the Kern County
Municipal Court have increased to a point where the revenue
obtained by the Court from a ticket exceeds its processing
cost; and
WHEREAS, the Municipal Court has informed the City
that retroactive to October 1, 1979, it will have to receive
$0.75 per parking ticket collected or it will transfer the
processing of parking tickets to the City; and
WHEREAS, the cost to the City to administer a
collection program would be greater than $0.75 per parking
ticket; and
WHEREAS, pursuant to Penal Code, Section 1463, the
Municipal Court is entitled to only 10% of the parking fines
collected unless the City enters into an agreement with the
Municipal Court.
NOW, THEREFORE, BE IT RESOLVED that the City
Council hereby:
1. Authorize the Mayor to enter into an agreement
with the West Kern Municipal Court to transfer to the
general fund of the County, $0.75 per parking ticket upon
which collection has been made, retroactive to October 1,
1979.
2. Recommends to the Judges of the Municipal
Court, that the attached bail schedule incorporated herein
as Exhibit "A" be adopted for parking-related violations.

I HEREBY CERTIFY that the foregoing Resolution was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on the 10th day of October, 1979, by the
following vote:
