HomeMy WebLinkAboutRES NO 76-79RESOLUTION NO. 76-79 RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD MAKING FINDINGS AND APPROVING AND ADOPTING AMENDMENT TO THE LAND USE ELEMENT AND CIRCULATION ELEMENT OF THE BAKERSFIELD METROPOLITAN AREA GENERAL PLA~/ IN THE AREA OF THE CITY KNOWN AS RIO BRAVO.'~ WHEREAS, the Planning Commission of the City of Bakersfield, in accordance with the provisions of Section 65351 of the Govern- ment Code held a duly noticed public hearing upon proposed amend- ment to the Land Use Element and Circulation (Transportation) Element of the Bakersfield Metropolitan Area General Plan in the Rio Bravo area, dated February, 1979, on April 4, 1979, and continued it from time to time as to such amendment (referred to as 1-79 Segment 2); and WHEREAS, said Planning Commission, at the continued public hearing conducted during the regular meeting held on August 15, 1979, made certain findings in reference to such amendments, and approved such amendments and transmitted same to the City Council, as shown in Planning Commission Resolution No. 46~79. NOW, THEREFORE, the Council of the City of Bakersfield Hereby Finds and Resolves as Follows: 1. That by separate resolution this Council has certified the Final EIR in connection with this proposal. 2. That the above recitals are true and correct. 3. That in accordance with Sections 65355 and 65357 of the Government Code, the City Council has held and conducted a duly noticed public hearing prior to the adoption of the amendment herein described. 4. That the portion of the Amendment to the Land Use and Circulation Element known as 1-79, Segment 2, and identified as Amendment of the Land Use Element and Circulation Element of the Bakersfield Metropolitan Area General Plan For the Rio Bravo Area, dated February, 1979, encompassing 21.6 miles, is.hereby approved and adopted. made: 5. That the following declarations. and.findings are (a) The objective of said project is the adoption of a long-range plan. for physical development, containing policies, plan recommendations and objectives, which meet the requirements of the California Planning and Zoning Law and city ordinances. ~b) That the project is a positive effort to reduce environmental impacts by preserving rare 'or unique environmental characteristics and responding to those physical features restric- ting or modifying development to protect the health, safety, and welfare of the residents .of the planning area. (c) Long-range impacts include the commitment of presently. vacant land to urban use, while preserving other land in a predominantly natural state. Such project proposes uses and developmentsintensities which are intended to minimize adverse impacts. (d) The project is a policy document resulting in indirect impacts, since it is a plan for general development and does not propose specific projects. It is dependant on additional administrative procedures and policy action by decision-making bodies prior to implementation. A major aspect of specific develop- ment projects is the Final EIR which permits focused analysis of localized or site-specific impacts. (e) There are no significant environmental effects which cannot be avoided upon the adoption of this segment of the General Plan Amendment. (f) The project proposes to protect and manage the major, lnatural features of the planning area and it is the intent that site~.specific mitigation measures be required through environ- mental analysis of specific development proposals. .(g) Reasonable alternatives Cincluding the "no project" alternative) were investigated. (h) The project promotes a stewardship role for the City to maintain and enhance the long'term productivity of the environ- ment as a regional asset which should not be'lost to short'term development pressures. The cumulative and long-term effect of the project is to maintain significant natural elements of the planning area, while providing for controlled development of land capable of supporting such development. (i) The primary environmental change involved would be the conversion of vacant land in its natural state to develop- ment for other uses. Although the project proposes preservation of land with severe physical constraints and proposes mitigating measures to be taken with development of other land, committing land to urban use would be a significant irreversible environmental' change within the timeframe of the Plan. (j) New urban development will occur through implemen- tation of the .Plan. However, such growth is directed to areas where the environmental capabilities of accommodating such growth is most feasible. o0o I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the.
