HomeMy WebLinkAboutRES NO 75-79RESOLUTION NO.~ 75-79 RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD DECLARING IT HAS REVIEWED, EVALUATED AND CONSIDERED THE INFORMATION CONTAINED IN THE FINAL EIR, MAKING FINDINGS AND CERTIFYING THAT THE FINAL EIR HAS BEEN COMPLETED IN COMPLIANCE WITH THE CALIFORNIA E~IRON- MENTAL QUALITY ACT, THE STATE EIR GUIDELINES AND CITY RESOLUTION NO. 39-78, RE PROPOSED GENERAL PLAN AMENDMENTS FOR THE PORTION OF LAND IN THE CITY OF BAKERSFIELD KNOWN AS RIO BRAVO. WHEREAS, it is proposed to amend the Land Use Element and the Circulation Element of the Bakersfield Metropolitan Area General Plan in the area of the City known as Rio Bravo, which territory consists of approximately 21 square miles of mostly vacant land annexed into the City of Bakersfield in September, 1977; and WHEREAS, a Draft Environmental Impact Report (Draft EIR) on said project was prepared by the Bakersfield Development Services Department upon a contract with a Consultant, circulated and distri- buted in accordance with the requirements of law and applicable regu- lations, the distribution list being included in the Final EIR; and WHEREAS, public and private agencies and individuals sub- mitted written comments on the Draft EIR, as listed in the Final EIR; and WHEREAS, a duly noticed public hearing was held and con- ducted by and before the City of Bakersfield Planning Commission in accordance with the procedures required by City Resolution No. 39-78, on April 4, 1979, at which hearing the public was entitled to comment upon the Draft EIR; and WHEREAS, the City responded in writing to'all significant environmental points raised by the public and private agencies and individuals commenting and any such points raised in the consultation, review and public hearing process and the Final EIR was completed by the Development Services Department and placed on the agenda of the regular meeting of the Planning Commission of August 15, 1979, for evaluation and consideration by said Commission; and WHEREAS, on August 15, 1979, by Resolution No. 18-79, the Planning Commission recommended to the City Council that the Final EIR be certified-as completed in compliance with CEQA, the State EIR Guidelines and City of Bakersfield Resolution No. 39'78. · . WHEREAS, certain comments upon the Draft EIR were responded to subsequent to August 15, 1979; and WHEREAS, on October 3, 1979, by Resolution.No. 53-79, the Planning Commission recommended to the City Council that the Final EIR, including said responses to comments, be certified as completed in compliance with CEQA, the State EIR Guidelines and City of Bakersfield Resolution No. 39-78. NOW, THEREFORE, the Council of the City of Bakersfield Hereby Determines, Finds and Resolves as Follows: '1. That the above recitals are true and correct. 2. That the Final Impact Report, dated February, 1979, in reference to the project of amending the Land Use Element and the Circulation Element of the Bakersfield Metropolitan Area General Plan in the area of the City known as Rio Bravo, has been reviewed, evalu- ated and considered by the City Council. 3. That the Final.EIR, in.reference to the project described above, is hereby certified as having been completed in compliance with the California Environmental Quality Act, the State EIR'Guidelines and City of Bakersfield Resolution No. 39'78. 4. That the Final EIR is an accurate and objective dis- cussion of the.proposed project and adequately discusses and describes the environmental considerations and mitigation measures which need to be considered prior to approval of the proposed project. 5.
