A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD REQUESTING THE BOARD OF SUPERVISORS
OF THE COUNTY OF KERN TO ORDER THE CONSOLIDATION
OF A SPECIAL MUNICIPAL ELECTION SUBMITTING TO THE
ELECTORS RESIDING WITHIN THE TERRITORY DESIGNATED
AS CITY OF BAKERSFIELD ANNEXATION NO. 273 (UNION
AVENUE NO. 9), THE QUESTION OF WHETHER THE ORDER
OF ANNEXATION SHALL BE CONFIRMED, WITH THE CON-
SOLIDATED SPECIAL STATE-WIDE ELECTION TO BE HELD
ON TUESDAY, NOVEMBER 6, 1979, AND SETTING FORTH
THE EXACT FORM OF THE QUESTION TO BE VOTED UPON
AT SUCH ELECTION AS THE SAME IS TO APPEAR ON THE
BALLOT.
WHEREAS, Section 23302 of the Elections Code of the
State of California provides that whenever an election called by
a city for the submission of any questions or proposition is to
appear upon the same ballot as that provided for a state-wide
election, the city shall, at least 74 days prior to the date of
the election, file with the Board of Supervisors, and a copy with
the County Clerk, a resolution of its governing body requesting
such consolidation and setting forth the exact form of any question
or proposition to be voted upon'at such election, as the same is
to appear on the ballot; and
WHEREAS, on the 8th day of August, 1979, this Council
did pass and adopt Resolution No. 64-79 , calling a Special Munici-
pal Election to be held in the territory described therein and
designated as City of Bakersfield Annexation No. 273 (Union Avenue
No. 9) on Tuesday, the 6th day of November, 1979, for the purpose
of submitting to the qualified electors of said territory, the
question of whether the order of annexation adopted on May 2, 1979,
shall be confirmed; and
WHEREAS, it is the desire of this Council that said
Special Municipal Election be consolidated with the Consolidated
Special State-wide Election to be held on Tuesday, the 6th day
of November, 1979.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Bakersfield as follows:
1. That the Board of Supervisors of the County of Kern
is hereby requested tomake an order, pursuant to Section 23302 of
the Elections Code of the State of California, consolidating the
Special Municipal Election called by the Council of the City of
Bakersfield, for the purpose of submitting to the qualified electors
of the territory designated as City of Bakersfie~d Annexation
No. 273 (Union Avenue No. 9) the question of whether the Order of
Annexation adopted by said Council on May 2, 1979, shall be con-
firmed, with the Consolidated Special State-wide Election to be
held on November 6, 1979.
2. That the form of the City of Bakersfield's question
to be voted upon at said election, as the same is to appear on the
ballot, is as follows:

tion No. 273 (Union Avenue No. 9) be No

3. That said Board of Supervisors is further requested
to provide that within the said territory, the election precincts,
polling places and voting booths shall, in every case, be the same
and there shall be only one set of election officers in each of the
precincts established and said territory for said Special Municipal
'Election and the Consolidated Special State-wide Election and that
the exact form of the question to be voted upon shall be set forth
in each ballot to be used at said Special Municipal Election within
the said territory.
4. Said Board of Supervisors is further requested to
cause said measure to be printed upon each of the ballots to be
used in said territory at said Special ~unicipal Election Consoli-
dated with the Consolidated Special State-wide Election within the
territory, including absent voter ballots. Said Board is further
requested to cause to be set forth said measure on all sample
ballots relating to the said Special Municipal Election and to mail
to the qualified electors within the territory designated as City
of Bakersfield Annexation No. 273 (Union Avenue No. 9), said
sample ballots and polling place cards and arguments, if any, relat-
ing to said Special Municipal Election, all in the time and in the
form required by law and to provide absent voter ballots for said
election for use by qualified electors of the said territory who
may be entitled thereto, in the manner provided by law.
5. That the said Board of Supervisors is hereby authori-
zed to canvass or cause to be canvassed the returns of said Special
Municipal Election in said territory, and are requested to certify
the results of the canvass of said returns to the Council of the
City of Bakersfield, who shall thereupon declare the results
thereof.
6. That the City Clerk is hereby directed to transmit
and file certified copies of this resolution with the Board of
Supervisors of Kern County and the County Clerk of Kern County,
as required by Section 23302 of the Elections Code and shall trans-
mit a certified copy to the Executive Officer of the Local Agency
Formation Commission of Kern County.

I HEREBY CERTIFY that the foregoing Resolution was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on the 8th day of August, 1979, by the following
vote:
