A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD CALLING A SPECIAL MUNICIPAL ELECTION
TO BE HELD ON TUESDAY, THE 6TH DAY OF NOVEMBER,
1979, SUBMITTING TO THE VOTERS RESIDING WITHIN
THE TERRITORY DESIGNATED AS CITY OF BAKERSFIELD
ANNEXATION NO. 273 (UNION AVENUE NO. 9), THE
QUESTION OF WHETHER THE ORDER OF ANNEXATION
SHALL BE CONFIrmED.
WHEREAS, the Council of the City of Bakersfield, by
Resolution No. 37-79, adopted the 2d day of May, 1979, did order
the territory designated as Annexation No. 273, Proceeding No. 654
(Union Avenue No. 9) and described in Exhibit "A", appended hereto,
annexed to the City of Bakersfield, subject to the confirmation
of the voters.
NOW, THEREFORE, BE IT RESOLVED AND ORDERED AS FOLLOWS:
1. That a Special Municipal Election is hereby called
to be held in the territory herein described, and designated as
Annexation No. 273 (Union Avenue No. 9), on Tuesday, the 6th day
of November, 1979, to be consolidated with the Consolidated Special
State-wide Election, for the purpose of submitting to the qualified
electors of said territory the following question:

"Shall the order adopted on May 2, 1979, by
the Council of the City of Bakersfield Yes
ordering the annexation to said City of
the territory described in said order
and designated as City of Bakersfield
Annexation No. 273 (Union Avenue No. 9) No
be confirmed?"
2. The affected territory within which such special
election shall be held is the territory designated as City of
Bakersfield Annexation No. 273 (Union Avenue No. 9) and described
in Exhibit "A" which is made a part of this resolution and
attached hereto.
3. That the precincts and polling places shall be
the same as provided and established in the City for said Special
Municipal Election and the Consolidated Special State-wide Elec-
tion to be held on November 6, 1979.
4. That the terms and conditions of the within des-
cribed annexation as contained in the Kern County Local Agency
Formation Commission's Resolution Making Determinations are
as follows:
"Since dissolution of that portion of County Service
Area No. 2 included in subject annexation would reduce the exist-
ing revenue base of said County Service Area, it is recommended
the Commission's approval of the proposal be subject to the
following: ,
A. The Commission waive the application of Govern-
ment Code Section 25210.90 under authority of Government Code
Section 54790(h).
B. The City of Bakersfield shall not cause the dis-
solution of that portion of County Service Area No. 2 included
within the corporate boundaries as long as the existing service
is being performed by said County Service Area."
5. That the vote required for confirmation of the order
of annexation is a majority vote.
6. That the City Clerk shall provide for proper
announcement for the filing of written argument for and written
argument against, the question to be submitted to the voters and
for rebuttal arguments thereto.
7. That upon annexation being confirmed, the territory
annexed shall.be liable for the general indebtedness of the
City existing at the time of annexation, in accordance with
the provisions of Section 35411 of the Government Code of the
State of California.
8. That proper request be made to the Kern County
Board of Supervisors for consolidation of the City of Bakersfield
Annexation Election with the Consolidated Special State-wide
Election to be held and conducted on Tuesday, the 6th day of
November, 1979, to be conducted by the County Clerk and that
the Board further be requested and authorized to canvass or cause
to'be canvassed the returns of said Annexation Election in the
City of Bakersfield and to certify the results of the canvass of
said returns to the Council of the City of Bakersfield, who
.shall thereupon declare the results thereof.
9. That the polls shall be open from 7 A. M. to
8 P. M. on November 6, 1979.
10. That the City Clerk shall mail a certified copy of
this Resolution to the Executive Officer of the Kern County Local
Agency Formation Commission by registered mail and transmit and
file certified copies with the Board of Supervisors of Kern
County and the County Clerk of Kern County.

I HEREBY CERTIFY that the foregoing Resolution was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on the 8th day of August, 1979, by the following

Beginning at the intersection of the west line of the east S7.75 feet of said
Section 19 with the south line of the north 30 feet of the last named Section,
said intersection being a point in the extgrior Corporate Boundary of the City
Of Bakersfield;

to the intersection of the east line of the west S7.75 feet of said Section 17
with the north line of the south 30 feet of the north half of last named Section,
said intersection being the northeast corner of Union Avenue, of 115.S feet in

right of way line of said Union Avenue; ~
