HomeMy WebLinkAboutRES NO 59-79RESOLUTION NO. 59-7b RESOLUTION OF INTENTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD TO CONSIDER THE GRANTING OF A FRANCHISE TO CONSTRUCT AND USE POLES, WIRES, CABLES, CONDUITS AND APPURTENANCES UNDER, ALONG OR UPON ANY OR ALL PUBLIC STREETS IN THE CITY OF BAKERSFIELD. WHEREAS, Warner Cable Corporation, has filed with the Council of the City of Bakersfield, an application requesting that a franchise be granted to it of the character and for the purpose mentioned in the form of notice hereinafter set forth: NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF BAKERSFIELD that hearing of objections to the granting thereof will be held at the time and place specified in the form of notice hereinafter set forth which the Clerk of the City is hereby directed to publish once within fifteen days after the passage of this resolution in the Bakersfield Californian, a newspaper of general circulation within said City, and that said notice shall be as follows: "NOTICE OF INTENTION TO HOLD HEARING FOR THE PURPOSE OF CONSIDERING GRANTING APPLICATION FOR FRANCHISE" NOTICE IS HEREBY GIVEN that Warner Cable Corporation, a corporation duly organized and existing under and by virtue of the laws of the State of Illinois, has filed its application with the Council of the City of Bakersfield requesting the Council to grant it a franchise within the city limits of Bakersfield, to use or construct and use, poles, wires, cables, conduits and appurtenances for the purpose of transmitting and distributing electricity and electrical impulses and signals for television and/or radio purposes, namely, to produce reproductions of sights and sounds to the residents of the City of Bakersfield, under, along or upon any or all public streets, ways, alleys and places of th~ City of Bakersfield as the same now exist or hereafter exist. The principal feature of the ordinance is as follows: 1. The term of the franchise is for eighteen years with a renewal period of seventeen years. 2. The amount payable to the City for the franchise is three percent (3%) of the gross annual receipts of the company from its operation in the City. 3. The franchise is non-exclusive. For further.particulars relative to the proposed ordin- ance granting said franchise, reference is made to the ordinance on file in the City Clerk's office, 1501 Truxtun Avenue, Bakersfield, California. NOTICE IS HEREBY FURTHER GIVEN that any and all persons having any objections to the granting of said franchise may appear before the City Council at City Hall at the hour of 8 o'clock p.m. on Wednesday, the 8th day of August, 1979, and be heard thereon.
