A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD MAKING FINDINGS AND DENYING A
PROPOSED AMENDMENT TO THE LAND USE ELEMENT OF
THE BAKERSFIELD METROPOLITAN AREA GENERAL PLAN.
WHEREAS, the Planning Commission of the City of
Bakersfield, in accordance with the provisions of Section 65351
of the Government Code held a public hearing commencing on
December 20, 1978, which was twice continued and completed on
April 18, 1979, on proposed amendment to the Land Use Element of
the Bakersfield Metropolitan Area General Plan, notice of the
time and place of the hearing having been given at least ten (10)
calendar days before the hearing by publication in the Bakersfield
Californian, a newspaper of general circulation published and
circulated in the City; and
WHEREAS, such proposed amendment to the Land Use Element
of the Bakersfield Metropolitan Area General Plan concerns property
general!y_located~ between PaCheco Road, the railroad tracks, Hughes
Lane and Freeway 99, containing approximately 14 acres, proposed
to be changed from industrial to medium-density residential; and
WHEREAS, by Resolution No. 30-79, adopted on April 18,
1979, the Planning Commission of the City of Bakersfield made
findings and recommended to this Council denial of the hereinbefore-
described amendment to the Land Use Element and in accordance with
Section 65354 of the Government Code, transmitted its report to the
City Council on May 10, 1979; and
WHEREAS, the Council of the City of Bakersfield, in
accordance with the provisions of Section 65355 of the Government
Code held a public hearing on May 16, 1979, on said proposed
amendment to the Land Use Element, notic~ of the time and place of
the hearing having been given at least ten (10) calendar days
before the hearing, by publication in the said Bakersfield

Californian.
NOW, THEREFORE, IT IS HEREBY FOUND AND RESOLVED as follows:
and correct.
II.
That the above recitals incorporated herein are true
That the proposed Amendment to the Land Use Element
of the Bakersfield Metropolitan Area General Plan consists of the
area described above and as shown on the maps attached hereto and
the staff report.
III. That, as to the said area above described, the
Negative Declaration was'nOt approved by the Planning Commission
on April 18, 1979, which recommended. denial of the proposed change,
and the said Negative Declaration is hereby disapproved by this
City Council on May 16, 1979, in accordance with CEQA, the State
EIR Guidelines and City Resolution No. 39-78.
IV. The Commission found that no sufficient showing had
been made to support the proposed change.
V. That the proposed Amendment to the Land Use Element
of the Bakersfield Metropolitan Area General Plan, consisting of
the above-described area, and as shown on the staff report and on
maps attached hereto, is hereby denied in accordance with Section
65357 of the Government Code.

I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield
at a regular meeting thereof held on the 16th day of May, 1979,
by the following vote:
