HomeMy WebLinkAboutRES NO 34-79RESOLUTION NO. '34-79 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAKERSFIELD AUTHORIZING THE TAKING OF PROPERTY BY EMINENT DOMAIN AND FINDING NECESSITY THEREFOR. WHEREAS, this Council'has heretofore approved the project known as the "Truxtun Avenue Extension" (including the environmental review thereof), which will extend Truxtun Avenue westerly to bring about relief of the extreme traffic congestion on the limited number of east-west streets now existing, and the said project is most neces- sary for the public safety and to meet the City's traffic circulation needs in accordance with the Transportation Element of the General Plan; and WHEREAS, the said project is planned and located in such a manner it will be most compatible with the greatest public'good and the least private injury, in that it connects with the existing Truxtun Avenue to the east and extends it to the west for connection to existing and planned north-sout~h streets over the most direct, feasible route without intrusion upon .private improvements or the severance of unusable parcels or parcels of greatly diminished value~ and WHEREAS, the property which is to be authorized to be taken hereby is located directly within the approved plan lines for said street extension which have heretofore been approved as to location and environmental impact; NOW, THEREFORE, BE IT RESOLVED: 1. All of the foregoing recitals are hereby found to be true and correct. 2. The property hereinafter described shall be taken for an easement_for use as a publi~ street and for general public utility purposes, within, by and for the City of Bakersfield, pursuant to its powers as set forth in Sections 37350.5 and 37353 of the Government Code of the State of California and Section 1230.010 and following of the Code of Civil Procedure of the State of California. Exhibit A and illustrated for convenient reference in Exhibit B. of said exhibits are appended hereto and are hereby incorporated herein by reference as though here fully set forth. 4. The Council hereby finds and determines that: (1) The public interest and necessity require the acquisition of an easement for public street and for general public utility purposes in, on, over, under, through and across the described property for, and the costruction of, a public street (the Truxtun Avenue Extension). (2) The acquisition of.property for, and the con struction of, said project are planned and located in the manner most compatible with the greatest public good and the least private injury. (3) The taking of t2he property hereinabove described is necessary for the'said pro posed project. The property to be taken pursuant hereto is described in All o0o.
