A RESOLUTION OF THE COUNCIL OF THE CITY
OF BAKERSFIELD ORDERING THE VACATION OF
PORTIONS OF "K" STREET, 38TH STREET, AND
40TH STREET, ADJACENT TO BLOCKS 666 AND
-667, IN THE CITY OF BAKERSFIELD.
WHEREAS, on the 28th day of February, 1979, the Council
of the City of Bakersfield, pursuant to the provisions of the
"Street Vacation Act of 1941," being Division 9, Part 3, ofthe
Streets and Highways Code of the State of California, passed and
adopted its Resolution of Intention No. 942 declaring its intention
to order the vacation of portions of "K" Street, 38th Street, and
40th Street, adjacent to Blocks 666 and 667, in the City of
Bakersfield, County of Kern, State of California; and
WHEREAS, said Council did fix a time and place for
hearing all persons interested in or objecting to said proposed
vacation which said hearing was held on the 28th day of March, 1979,
after notices were duly posted as required by law; and
WHEREAS, this Council after duly considering the matter,
does hereby find and resolve as follows:
1. That portions of "K" Street, 38th Street, and 40th
Street, adjacent to Blocks 666 and 667, in the City of Bakersfield,
County of Kern, State of California, more particularly described
in Exhibit "A" attached hereto and made a part hereof, is unnecessary
for present or prospective public street purposes.
2. That said portions of "K" Street, 38th Street, and
40th Street, adjacent to Blocks 666 and 667, be and the same are
hereby closed up, vacated'and abandoned for public street purposes,
subject to and in conformity with the reservations and exceptions
contained in and contemplated by said_Resolution of Intention No. 942.
Reference to said Resolution of Intention is hereby made for
further particulars.
3. That the City Clerk shall certify to the passage of
this Resolution and shall cause a certified copy hereof, attested
by the Clerk under the seal of the City, to be recorded in the
office of the County Recorder of the County of Kern, California.

EXHIBIT "A"
All those portions of 38th Street, 40th Street and "K" Street in the
City of Bakersfield,.as shown on the map in Book 1 of Maps at page 13,
filed on April 19, 1904 in the office of the Kern County Recorder, more
particularly described as follows:
PARCEL 1
The northerly 11.25 feet of the 82.5 foot right of way for 38th Street as
shown on said map, lying between the southerly prolongations of the west
boundary line of Block 667 and the east boundary line of Block 666 as
shown on said map.
PARCEL 2
The southerly 11.25 feet of the 82.5 foot right of way for 40th Street
as shown on said map, lying between the northerly prolongations of the
west boundary line of Block 667 and the east boundary line of Block 666
as shown on said map.
PARCEL 3
The easterly 11.25 feet of the 82.5 foot right of way for "K" Street as
shown.on said map, lying between the westerly prolongations of the north
boundary line and the south boundary line of Block 667 as shown on said
map..
I HEREBY CERTIFY that the foregoing Resolution was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on the 28th day of March, 1979, by the following
vote:
