HomeMy WebLinkAboutRES NO 21-79RESOLUTION NO.' 21-79 RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD INITIATING PROCEEDINGS FOR ANNEXA- TION OF TERRITORY TO THE CITY OF BAKERSFIELD IDENTIFIED AS PROCEEDING NO. 673, ANNEXATION NO. 276 (PACHECO NO. 9), IN ACCORDANCE WITH LAFCO RESOLUTION MAKING DETEM~INATION. WHEREAS, a proposal was submitted to the Local Agency Formation Commission of Kern County ("Commission") for the annexa- tion of territory to the City of Bakersfield designated as Annexa- tion No. 276 (PACHECO NO. 9); and WHEREAS, a duly noticed public hearing upon said proposal was held before the Commission on the 13th day of February, 1979; and WHEREAS, following said public hearing the Commission, on February 13, 1979, adopted its Resolution Making Determination, being Resolution No. 79-20, recorded in Minute Book 23 of said Commission. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. Preliminary proceedings for annexation of territory to the City of Bakersfield designated as Annexation No. 276 (PACHECO NO. 9) were authorized by the City Council of the City of Bakersfield by action at a regular meeting thereof held on October 4, 1978; Appli- cation for Annexation dated October 17, 1978, was transmitted to LAFCO; the Certificate of Filing of the Executive Officer of the Commission shows that the proposal was filed by him on the 3d day of January, 1979. 2. The distinctive short form designation assigned by the Commission to the territory proposed to be annexed is: "City of Bakersfield Annexation No. 276 "(PACHECO NO. 9)." 3. The description of the exterior boundaries of the territory proposed to be annexed is contained in Exhibit "A", attached hereto, and incorporated in this Resolution as though fully set forth herein. 4. The territory proposed to. be annexed is uninhabited as determined by the Commission in its Resolution Making Determina- tion. 5. The reasons for the proposed annexation as set forth in the proposal thereof submitted to the Commission are as follows: a. Certain owners of property within the territory have requested annexation'into the City of Bakersfield. b. The requested annexation'is proper and logical for orderlygrowth of the City. c. Future intended use~ are in accordance with the adopted Bakersfield Metropolitan Area'General Plan. d. Tentative Tracts 4001 and 4108 with appropriate environmental documents have been approved by the City subject to annexation to the City of Bakersfield. e. The proposed annexation will not adversely affect the level or capacity of the City to deliver necessary public services. f- Approximately 70% of the proposed boundary line is contiguous with the City limits of Bakersfield. g. 'Sewer facilities presently exist within the boundary of the proposed annexation and were sized to accommodate this territory. Street. h. City presently provides street lights along "H" i. A City-owned and -maintaineddrainage basin presently exists within the territory north of Pacheco Road and easterly of HUghes Lane· ~ 6. BE IT FURTHER RESOLVED, that Wednesday, the llth day of April, 1979, at the hour of 8 P. M. (or as soon thereafter as the matter may be heard) in the Council Chambers of the City Hall, 1501 Truxtun Avenue, Bakersfield, California, is hereby fixed as the time, date and place of hearing on the proposed annexation where any owner of land within the said described territory may appear before the Council of the City of Bakersfield and show cause why such territory should not be annexed. Any owner of land within the territory may file a written protest against the annexation with the City Clerk of the City of Bakersfield at 1501 Truxtun Avenue at any time 'prior to the conclusion of the hearing on the proposed annexation. 7. That the Negative Declaration as to this project is hereby approved and adopted. The project will not have a signifi- cant effect on the environment. 8. A certified copy of this Resolution shall forthwith be transmitted to the Executive Director of LAFCO. o0o ANNEXAI'ION NO. 276 PACHECO NO. 9 A parcel of land situate in the Cottory of Kern, State Of California, and being portions of Sectbns 1~ and 24, To~T~ship 30 South, Range 27 East, and portions of Sections 18 and 19, Township 30 South~ Range 28 East, M.D.M., more particularly described as follows: Beginning at thz intersection of the east line of the west 30 feet of said Section 18, with the south line of tile north 30 feet of the southwest quarter of said Sec~ioh 18, said intersection being in the existing exterior Corporate Botmdary of the City of Bakersfield; " THENCE (1) southerly and easterly along said existing Corporate Boundary to the north- west conmet of the east half of the northeast quarter of the northwest quarter of said Section 19, said corner also being the southeast corner of Tract No. 3269 recorded September 25, 1969 in Book 18 of Maps, Page 68 in the Office of the Kern County Recorder; THENCE (23 departing said exterior Corporate Boundary S 0° 00' 31" E, a dist~lnce of 45 feet, more or less, to intersect the south line of the'north 45 feet of said Section 19, also being tile southerly right Of way line of Pacheco Road; THENCE (3) westerly along said south line a distance of 830 feet, more or less, to the intersection of the west line of the east 163.58 feet of the northwest quarter of the northwest quarter of said Section 19; THENCE (4) southerly along said west line a distance of 1290 feet, more or less, to intersect the south line of said northwest quarter of the northwest quarter of said Section 19; THENCE (5) easterly along said south line a distance of 163.58 feet,'more or less, to intersect the east line of the southwest quarter of said northwest quarter of said Section 19; THENCE (6) southerly along said east line a distance of 660 feet, more or less, to intersect the north line of the south half of the southwest quarter of th~ northwest quarter of said Section 19; THENCE (7) westerly along said' north line and along the north line of the south half of the' southeast'quarter of the northeast quarter of said Section 24, a distance of 1514 feet, more or less, to a point in the west line of the east 30 fee~ of said Scction 24, said west line being the westerly right of way line of South "H" Street and said existing exterior Corporate Boundary; THENCE (8) northerly and westerly along said exterior Corporate Boundary to the inter- section of the north line of the south 40 feet of the north half of. the northeast ~uarter of said Section 24, with the west line of the east 185.53 feet of said northeast quarter, said west line also being the east line of Tract No. 2646, recorded May 4, 1962 in Book 12 of Maps, Page 182 in the Office of the Kern qounty Recorder; THENCE (9) departinE said exterior Corporate Bo~mdary along said east line, and along the east line of Tract 2394, recorded November 17, 1968 in BOok 11 of Maps, Page 137 in the Office of the Kern County Recorder, N 0° 04' 49" E, a distance of 1236.83 feet to intersect the south line of the north 45 feet of the northeast quarter of said Section 24, said south line being the southerly right of way line of Pacheco Road; THENCE {10) westerly along said south line and said southerly right of way line, a distance of 1130 feet, more or less, to intersect the.existing exterior Corporate Boundary; THENCE (11) northerly and westerly along said exterior Corporate Boundary to the inter- section of'the west line of the east 4S'-feet-of-the-northwest quarter of said Section 24, with the south line of the north 50 feet of last named Section; THENCE (12) northerly along said west line and along the west line of the east 45 feet of the southwest quarter of Section 13, a distance of 1250 feet, more or less, to intersect the existing exterior Corporate Boundary; THENCE (i3) northeasterly and along various courses of said exterior Corporate Boundary to the Point of Beginning.
