RESOLUTION OF APPLICATION OF THE COUNCIL OF
THE CITY OF BAKERSFIELD PROPOSING PROCEEDINGS
FOR DETACHMENT OF TERRITORY FROM THE NORTH
BAKERSFIELD RECREATION AND PARK DISTRICT,
IDENTIFIED AS A PORTION OF ANNEXATION NO. 250
(KERN RIVER NO. 6).
WHEREAS, the Local Agency Formation Commission of Kern
County, in its Resolution Making Determination No. 78-40, adopted
August 22, 1978, .(Proceeding No. 592), approved the proposal for
annexation to the City of Bakersfield designated as Annexation
No. 250 (KERN RIVER NO. 6) subject to the condition (among others)
that upon such annexation, the City of Bakersfield make application
to detach North Bakersfield Recreation and Park District territory
lying within the annexed territory; and
WHEREAS, in accordance with the condition imposed as
aforesaid, the City of Bakersfield as an "affected city" desires to
propose a change of organization, to wit: the detachment from the
North Bakersfield Recreation and Park District of the hereinafter-
described territory, under the authority of Section 56195 of the
Government Code of the State of California.
NOW, THEREFORE, the Council of the City of Bakersfield
hereby RESOLVES, FINDS AND DETERMINES as follows:
1. That the City of Bakersfield hereby proposes the
detachment from the North Bakersfield Recreation and Park District of
the uninhabited territory described in Exhibit "A" attached hereto,
and made a part of this Resolution as though fully set forth herein.
2. That a map of the territory proposed to be so detached,
marked Exhibit "B", is attached hereto, and made a part of this
Resolution as though fully set forth herein.
3. That this proposal for change of organization, to-wit:
detachment, is made pursuant to the District Reorganization Act of
1965, commencing with Section 56000 of the Government Code of the
State of California, and it is requested that proceedings be authorized
for detachment in accordance therewith.
I HEREBY CERTIFY that the foregoing Resolution was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on the 6th day of December, 1978, by the follow-
ing vote:

4. That the reasons for the proposed change of organiza-
tion are as follows: most of the land annexed by the City of
Bakersfield in Annexation No. 250 (KERN RIVER NO. 6) is owned in fee
by the City and therefore tax-exempt, the small portion of lands
under private ownership affected by the proceeding will be relieved
of the special district tax and subject to the City tax rate; the
City is required to initiate preliminary proceedings for detachment
of territory from the North Bakersfield Recreation and Park District
by order of the Local Agency Formation Commission of Kern County as
a condition of the annexation of territory to the City of Bakersfield
in Annexation No. 250 (KERN RIVER NO. 6).
5. That the Local Agency Formation Commission found and
determined on August 22, 1978, that Proceeding No. 592, Annexation
No. 250 (KERN RIVER NO. 6), a project including this detachment,
will not have a significant effect on the environment and on such
date entered its Environmental Negative Declaration.
6. That the names of the officers of the City of Bakers-
field who are to be furnished with copies of the Executive Officer's
Report and who are to be given mailed Notice of Hearing, if any,
are:

1110 Twenty-Sixth Street, Bakersfield, California 93301.

A parcel of land situate in the County of Kern, State of California, being portions
of Sections 1, 2 and 3, Township 30 South, Range 26 East, M.D.M., more particularly
described as follows:
Beginning at the intersection of the northerly right of way line of County Road 1594
(Stockdale Highway), of 60 feet in width, with the west line of the east 30 feet of
said Section 1, said point being southerly along said west line a distance of 1248.50
feet from the north line of said Section 1, being'a point on the exterior boundary
of the North Bakersfield Recreation and Park District;
THENCE (1) along said boundary S 0° 06' 48" W, along last named west line, a distance
of 229.56 feet to a point of cusp of a tangent curve concave to the southwest having
a radius of 120 feet;
THENCE (2) departing from said exterior boundary, northerly and westerly along last
named curve through a central angle of 10S° 44' 19", an arc distance of 221.46 feet
to apoint in a tangent reverse Curve concave to the north, having a radius of 930
feet, from which point the radial for said reverse curve bears N 15° 37' 31" W;
THENCE (3) westerly along said reverse curve through a central angle of 52° 30' 10",
an arc distance of 852.20 feet to a point in the southerly boundary of Parcel 1 of
that certain Quitclaim Deed to the City of Bakersfield recorded June 6, 1977 in
Book 5032, Page 456 O.R. in the Office of the Kern County Recorder;
THENCE along the southerly boundary of said Parcel 1 the following ten (10) courses;

line of the south 1870 feet of said Section 2;

to the point of intersection of the west line of the east 1375 feet and the north
line of the south 1735 feet of said Section 2;
THENCE (16) westerly along last named north line, a distance of 335 feet, more or
less, to intersect the east line of the west 930 feet of the southeast quarter of
said Section 2;

to intersect the east line of the southwest quarter of said Section 2 at a point
which lies 1500 feet southerly, as measured along last named'east line from the
northeast corner of last named southwest quarter;

quarter of said Section 2, a distance of 1790 feet, more or less, to intersect
the east line of the west 850 feet of said Section 2;

boundary of that certain parcel of land deeded to the City of Bakersfield as

less, to intersect the west line of the east half of said Section 3;
THENCE (28) northerly along last named west line, a distance of 2640 feet, more
or less, to intersect the north line of the south half of said Section 3;
THENCE (29) departing from said exterior boundary, easterly along last named north
line, a distance of 2610 feet, more or less, to intersect the west line of the
east 30 feet of said Section 3;
THENCE (30) northerly along last named west line, a distance of 2610 feet, more
.or less, to a point in the south line of the north 30 feet of said Section
said point being a point in the southerly right of-way line of County Road
.No. 696 (Stockdale Highway);
THENCE (31) easterly along last named southerly right of way line through said
Sections 3 and 2 to the east line of said Section 2;

2328.94 feet, said point being a point in the southeasterly right of way line of
the Cross Valley Canal, as described in that certain Complaint in Eminent Domain
entitled "Kern County Water Agency, a political subdivision of the State of
California, Plaintiff, vs. Tenneco West, Inc., a Corporation, et al, Defendants,"
Case No. 127931 in the Superior Court of California, County of Kern;
THENCE along said southeasterly right of way line the following 12 courses;
THENCE (33) N 44° 11' 40" E a distance of 208.13 feet;
THENCE (34) S 45° 48' 20" E a distance of 30.00 feet;

THENCE (36) northeasterly along a tangent curve concave to the southeast, with
a radius of 890.00 feet, through a central angle of 35° 48' 28" an arc length

THENCE (37) N 80° 00' 08" E a distance of 459.52 feet;
THENCE (38) northeasterly along a tangent curve-concave to the northwest, with
a radius of 1110.00 feet, through a central angle of 14° 41' 47" an arc length
of 284.72 feet;
THENCE (39) N 65° 18' 21" E a distance of 1041.68 feet;
THENCE (40)'S 24° 41' 39" E a distance of 5.00 feet to a point on a non-tangent
curve, concave to the southeast, with a radius of 885.00 feet, from which point
the radial.point of said curve bears S 24° 41' 39" E;
THENCE (41) northeasterly, along said curve, through a central angle of 10° 31' 54",
an arc distance of 162.67 feet;

THENCE (43) northeasterly along a tangent curve, concave to the northwest, with a
radius of 365.00 feet, through a central angle of 13° 48' 48", an arc length of

THENCE (44) N.62° 01' 27" E, a distance of 862 feet, more or less, to a point in
the west line of the northeast quarter of the northeast quarter of said Section 1;
THENCE (45) southerly along last named west line, a distance of 300 feet, more or
less, to intersect the northerly right of way line of said Stockdale Highway, of
60 feet in width;
THENCE '(46) along said northerly right of way line S 51° 18' 32" E, a distance of
430 feet, to the beginning of a tangent curve concave to the west, having a radius
of 870 feet;
THENCE (47) southeasterly along said curve, through a central angle of
57° 26' 28", an arc length of 872.21 feet to the POINT OF BEGINNING.
