HomeMy WebLinkAboutRES NO 103-78 .. -. .. . .. t ... RESOLUTION NO. 103-78 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD SETTING FORTH THE ANNEXATION POLICY OF THE CITY OF BAKERSFIELD. WHEREAS, the Knox-Nesbit Act sets forth as one of its fundamental purposes the "discouragement of urban sprawl and the encouragement of the orderly formation and development of local governmental agencies based on local conditions and circumstances." WHEREAS, the legislative mandate of the Municipal Organi- zation Act of 1977 (MORGA) states: "The Legislature finds and declares that a single govern- mental agency, rather than several limited purpose agencies, is better able to assess and be accountable for community service needs and financial resources and, therefore, is the best mechanism for establishing community service priorities." WHEREAS, the City desires to develop an annexation policy that will provide the City of Bakersfield and property owners maximum opportunity to plan for and coordinate the extension of those public facilities and services that will be required as urban development of the lands occur. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. Annexation Policy Within Service Boundary a. In view of the legislative mandate both of the Knox-Nesbit Act and MORGA, and to avoid further piece-meal planning and incrementalization, when the statutory requirements for an annexation have been met, it is the policy of the City to pursue the annexation of territory within a designated service boundary. b. The designated service boundary is established as shown in Exhibit A. Such service area is based upon factors includ- ing but not limited to: M -- " (1) Territory is within the urban area. (2) The City presently provides urban services that are used by residents or occupants of the area. (3) Location of territory with respect to availability of police and fire services. (4) The availibility of sewer and water facilities. (5) The type and condition of existing pUblic improvements within the area and the cost to maintain same. (6) The lack of needed physical improvements within the area (i.e., streets, drainage, street lights, fire hydrants, sewers, traffic signals, etc.) (7) Economic feasibility of annexing the territory (Cost/Revenue). (8) The effects of revenue limitations as a result of Proposition 13. 2. Annexation Policy Outside Service Boundary For areas outside the designated service boundary (Exhibit "A"), the City should not pursue the annexation of any territory except as follows: a. If the land owner of owners of uninhabited pro- perties desire to annex to the City of Bakersfield, they must formulate a development plan. Such plan should set forth existing and proposed land use and circulation, phasing of proposed develop- ment, and a determination of the approaches for providing municipal services in a phased and cost effective manner to accommodate the planned development without imposing undue burdens on City taxpayers. b. If the area under consideration is inhabited, the cost of improvements and upgrading of existing facilities as required by the City shall be borne by the property owners. An annexation fee may be established based on conditions relating to the area. c. In all cases a financial impact study of annexing territory shall be conducted. ----------000---------- -2- .. -. . . , . . . .
