HomeMy WebLinkAboutRES NO 102-78RESOLUTION N0-""1'02-78 A RESOLUTION OF THE COUNCIL'OF THE CITY OF BAKERSFIELD ORDERING THE VACATION OF A PUBLIC UTILITIES EASEMENT LOCATED NORTH OF MARSHA STREET AND WEST OF SOUTH MONTCLAIR, IN THE CITY OF BAKERSFIELD. WHEREAS, on the 23d day of August, 1978, the Council of the City of Bakersfield, pursuant to the provisions of the "Public Service Easements Vacation Law," being Sections 50430 to 5044.5, inclusive, of the Government Code of the State of California, passed and adopted its ReSolution of Intention No. 935 declaring its intention to order the vacation of public service easements, also referred to herein as public utilities easements, situated north of Marsha Street and West of South Montclair, in the City of Bakersfield, County of Kern, State of California; and WHEREAS, said Council did fix a time and place for hearing all persons interested in or objecting to said proposed vacation which said hearing was held on the 20th day of September, 1978, after notices were duly posted as required by law; and WHEREAS, this Council after duly considering the matter, does hereby find and resolve as follows: 1. That said public service easements also referred to herein as public utilities easements, hereinafter described, are unnecessary for present or prospective public use: A parcel of land situate in the City of Bakersfield, County of Kern, State of California, and being a portion of the northwest quarter of Section 2, Township 30 South, Range 27 East, M.D.M., more particularly described as follows: The 10-foot by 15-foot public utilities easement located at the southeast corner of Lot 6 of Tract No. 3408, as said Tract is shown in Book 19 of Maps at page 74, filed July 10, 1970, in the office of the Kern County Recorder. 2. That said public service easements.beand the same are hereby vacated and abandoned for public service easement pur- poses, subject to and in conformity with the reservation of the easements contained in and contemplated by said Resolution of Intention No. 935. Reference to said Resolution of Intention is hereby made for further particulars. 3.
