RESOLUTION OF THE COUNCIL OF THE CITY'OF
BAKERSFIELD INITIATING PROCEEDINGS FOR ANNEXA-
TION OF TERRITORY TO THE CITY OF. BAKERSFIELD
IDENTIFIED AS ANNEXATION NO. 250, PROCEEDING
NO. 592, (KERN RIVER NO.. 6), IN ACCORDANCE
WITH LAFCO RESOLUTION MAKING DETERMINATION.
WHEREAS, a proposal was submitted to the Local Agency
Formation Commission of Kern County ("Commission.") for the annexa-
tion of territory to. the City of Bakersfield designated as Annexa-
tion.No. 250 (KERN RIVER NO. 6); and
WHEREAS, a duly noticed public hearing upon said proposal
was held before the Commission on the 8th day of August, 1978~ which
hearing was continued until the 22d day of August, 1978; and
WHEREAS, following said public hearing the Commission, on
August 22,.1978, adopted its Resolution Making Determination, being
Resolution No. 78-40, recorded in Minute Book 22 of said Commission.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Bakersfield as follows:
1. Preliminary proceedings for annexation of territory
to the City of Bakersfield designated as Annexation No. 250 (KERN
RIVER NO. 6) were authorized by the City Council of the City of
Bakersfield by.action at a regular meeting thereof held on May 31,
1978~_ AppliCation for Annexation dated June~_8.~. 19~8.~+was transmitted
to LAFCO;the Certificate 0f Filing of the Executive 6fficer of the
Commission shows that the proposal was filed by him on the 8th day of
August, 1978.
2. The distinctive short form designation assigned by
the Commission to the territory proposed to be annexed is: "City
of Bakersfield Annexation No.250 (KERN RIVER NO. 6)."'
3. The description of the exterior boundaries of the
territory proposed to be annexed is contained in Exhibit"'A",
attached hereto, and incorporated in this Resolution as though
fully set forth herein.
4. The territory proposed. to be annexed.is uninhabited
as determined by the Commission in.its Resolution Making Determina-
tion.
5. The reason for the proposed annexation as set forth
in the proposal thereof submitted to the Commission is that the
owners of subject property'wish 'to receive municipalservices. The
City owns approximately 2,900 acres of the land and desires to include
such land within the City for tax purposes·
6. The following terms and conditions of the proposed
annexation are contained in 'the Commission's Resolution Making
'Determinations.
(a) Immediately upon annexation., the City shall make
aPPlication~to LAFCO todetach the North Bakersfield Recreation
and Park District 'and the.NorthKern Water Storage District terri-
tories lying within the annexed territory, from the City.
7. BEIT FURTHER RESOLVED, that Wednesday the 25th day of
October, 1978, atethe hour of 8 P. M. (or as soon thereafter as the
matter may be heard) in the Council Chambers of the City Hall, 1501
Truxtun Avenue, Bakersfield, California, is hereby fixedas the
time, date andsplace ofhearing on the proposed annexation where
any owner of land within the said described territory may appear
before the Council of the City of Bakersfield and show cause why
'such territory should not be annexed. Any owner of land within the
territory may file a written protest against the annexation with
the Cit_y Clerk of the City of Bakersfield at 1501 Truxtun Avenue at
any time prior to the conclusion of the hearing on the proposed
annexation.
9. That by Resolution No..49-78, adopted on May 31,
1978, the council of the City of Bakersfield declared' it had
-reviewed., evaluated-an~ conside~ed--t-he-informa-t-ien-contained in-the~-
Final EIR for KERN RIVER NO. 6 Annexation, made.findings and certi-
fied that the Final EIR had been completed in compliance with the
California Environmental Quality Act, the State EIR Guidelines, and
City of Bakersfield Resolution No. 39-78.
10. A' certified copy' of this Resolution shall forthwith
be transmitted to the ExecutiVe Director of LAFCO.

I HEREBY CERTIFY that the'foregoing ReSolution was passed
and adopted by the Councilof the City of Bakersfield at a regular
meeting thereof held on the 20th day of September, 1978, by the
