A RESOLUTION OF THE COUNCIL OF THE CITY
OF BAKERSFIELD DECLARING THAT A MAJORITY
PROTEST HAS NOT BEEN MADE TO THE ANNEXATION
OF MANOR NO. 2, PROPOSED TO BE ANNEXED TO
THE CITY OF BAKERSFIELD.
WHEREAS, pursuant to the Government Code of the State
of California, Sections 34300 and following, proceedings have
been instituted for the annexation of certain territory designated
as Annexation No. 258, MANOR NO. 2; and
WHEREAS, pursuant to such proceedings a petition was
signed and filed for such annexation, a resolution adopted describ-
ing boundaries of the territory sought to be annexed, publications
had on said resolution and a time adopted for hearing of protests
from persons owning real property in said territory; and
WHEREAS, a hearing was duly held in the Council Chambers
of the City Hall in the City of Bakersfield on the 6th day of
September, 1978, at the hour of 8 P. M. pursuant to notices given
in compliance with law; and
WHEREAS, Wednesday, September 6, 1978, at the hour of
8 p.m.was the time set for hearing protests by any person owning
property within the aforesaid territory.
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Bakersfield as follows:
That at the time set for hearing protests to the proposed
annexation and at the time to which said hearing was held a
majority protest has not been made by private owners of one-half
the value of the territory proposed to be annexed, as shown by
the last-equalized assessment roll, or by public and private
.owners equal to one-half of the value of said territory, said
property being designated as Annexation No. 258 (_MANOR NO. 2)
and more particularly described in Resolution No~ 79-78 of the
City of Bakersfield.

I HEREBY CERTIFY that the foregoing Resolution was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on the 6th day of September, 1978, by the following
vote:

APPROVED as to form:
WHEREAS, the City has responded in writing to all signi-
ficant environmental points raised by the public andprivate agencies
and individuals. commenting and any such points raised in the con-
sultation, review and publiclhearing process and the Final EIR, con-
sisting of the Draft EIR, comments and recommendations. received on
the Draft EIR, a list of persons, or organizations and public agencies
commenting on the Draft EIR and the responses of the City as afore-
said, has been completed by the Development Services Department and
placed on the agenda of the regular meeting of the Planning Commis-
sion of August 16, 1978, for evaluation and consideration by said
Commission; and
WHEREAS, at the said regular meeting, the Planning Commis-
sion did evaluate and consider the Final EIR and by its Resolution
No. 32-78, adopted on August 16, 1978, recommended to the City
Council that the Final EIR be certified as completed in compliance
with the California Environmental Quality Act, the State EIR Guide-
lines and City of Bakersfield Resolution No. 39-78·
NOW, THEREFORE, the Council of the City of Bakersfield
Hereby Determines, Finds and Resolves as Follows:
1. That the above .recitals are true and correct.
2. That the Final Environmental Impact Report, dated
August, 1978, in reference to the project described above, has
been reviewed, evaluated and considered by the City Council.
3. That said Final EIR is hereby certified as having
been completed in compliance with the California Environmental
Quality Act, the State EIR Guidelines and City of Bakersfield
Resolution No. 39-78.
4. That the Final EIR is an accurate and objective dis-
cussion of the proposed project and adequately discusses and des-
cribes the environmental considerations, alternatives and mitiga-
tion measures which need to be considered prior to the approval of
the proposed project·
