RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD DECLARING IT HAS REVIEWED, EVALUATED
AND CONSIDERED THE INFORMATION CONTAINED IN THE
FINAL FOCUSED EIR, MAKING FINDINGS AND CERTI-
FYING THAT SUCH FINAL EIR HAS BEEN COMPLETED
IN COMPLIANCE WITH THE CALIFORNIA ENVIRONMENTAL
QUALITY ACT, THE STATE EIR GUIDELINES AND CITY
RESOLUTION NO. 24-77, RE ANNEXATION NO. 250
(KERN RIVER NO. 6) AND AMENDMENT OF LAND USE
ELEMENT FOR APPROXIMATELY 311 ACRES FROM
AGRICULTURAL IN THE COUNTY TO LOW-DENSITY
RESIDENTIAL UNDER CITY JURISDICTION.
WHEREAS, it is proposed to annex approximately 3,380
acres to the City of Bakersfield, including approximately 2,901
acres of City-owned property used for water spreading and farming
in the Kern River Floodway; and approximately 479 acres of privately-
owned property, 168 acres of which is located in the Kern River
Floodway and 311 acres of which is located north of the Cross Valley
Canal and south of Stockdale Highway and between Allen and Renfro
Roads, which is potentially developable to low-density residential
uses; and
WHEREAS, a Draft Focused Environmental Impact Report on
said project was prepared by the City of Bakersfield Development
Services Department and circulated and distributed in accordance
with the requirements of law and applicable regulations, the dis-
tribution list being included in the Final EIR; and
WHEREAS, the scope of the Draft Focused EIR explores
principally the environmental impacts associated with the approxi-
mately 311 acres of privately-owned land potentially developable
to urban, low-density uses; the environmental impacts associated
with the remaining acreage of the proposed annexation were fully
discussed in that Final EIR entitled "Use and Disposition of
Property and Water Rights Acquired by the City of Bakersfield from
Tenneco West, Inc., in Settlement of Litigation"; and
WHEREAS, public agencies and individuals submitted
written comments on the said Draft EIR, as listed in the Final
EIR; and
WHEREAS, Notice of Completion of the Draft Focused EIR
was filed on March 21, 1978; and
WHEREAS, a duly noticed public hearing was held and
conducted by and before the City of Bakersfield Planning Commis-
sion in accordance with the procedures required by City Resolution
No. 24-77, on May 3, 1978, at which hearing the general public was
entitled to comment upon the said Draft EIR; and
WHEREAS, the City has responded in writing to all sig-
nificant environmental points raised by the public agencies and
individuals commenting and any such points raised in the consultation,
review and public hearing process, and the Final Focused EIR, con-
sisting of the Draft EIR, comments and recommendations received
thereon, a list of persons or organizations and public agencies
commenting thereon and the responses of the City as aforesaid has
been completed by the Development Services Department and placed
on the agenda of the regular meeting of the Planning Commission of
May 17, 1978, for evaluation and consideration by said Commission;
and
WHEREAS, the Planning Commission, by Resolution No. 18-78,
adopted on May 17, 1978, approved the Final Focused EIR and recom-
mended to the City Council that it be certified as completed in
compliance with the California Environmental Quality Act, the State
EIR Guidelines, and City of Bakersfield Resolution No. 24-77.
NOW, THEREFORE, the Council of the City of Bakersfield
Hereby Determines, Finds and Resolves as Follows:
1. That the above recitals are true and correct.
2. That the Final Focused Environmental Impact Report,
dated May, 1978, in reference to the project described above, has
been reviewed, evaluated and considered by the City Council.
3. That the Final Focused EIR is hereby certified as
having been completed in compliance with the California Environ-
mental Quality Act, the State EIR Guidelines and City of Bakersfield
Resolution No. 24-77.
4. That the said Final Focused EIR is an accurate and
objective discussion of the proposed project and adequately dis-
cusses and describes the environmental considerations, alternatives
and mitigation measures which need to be considered prior to the
approval of the proposed project.

I HEREBY CERTIFY that the foregoing Resolution was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on the 31st day of May, 1978, by the following
vote:
