HomeMy WebLinkAboutRES NO 46-78RESOLUTION NO. 46-78 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD ORDERING THE VACATION OF "P" STREET BETWEEN FREEWAY ROUTE 178 AND 25TH STREET, IN THE CITY OF BAKERSFIELD. WHEREAS, on the 26th day of ADril, 1978, the Council of the City of Bakersfield, pursuant to the provisions of the "Street Vacation Act of 1941," being Division 9, Part 3, of the Streets and Highways Code of the State of California, passed and adopted its Resolution of Intention No. 932 declaring its intention to order the vacation of "P" Street between Freeway Route 178 and 25th Street, in the City of Bakersfield, County of Kern, State of California; and WHEREAS, said Council did fix a time and place for hearing all persons interested in or objecting to said proposed vacation which said hearing was held on the 17th day of May, 1978, after notices were duly posted as required by law; and WHEREAS, this Council after duly considering the matter, does hereby find and resolve as follows: 1. That "P" Street between Freeway Route 178 and 25th Street, in the City of Bakersfield, County of Kern, State of California, more particularly described as follows, is unneces- sary for present or prospective public street purposes: A parcel of land situate in the City of Bakersfield, County of Kern, State of California, being a portion of Section 30, T29S, R28E., M.D.B.& M. and more particularly described as follows: That portion of "P'~ Street, of 82.5 feet in width, being bounded on the north by the south right-of-way line of 25th Street, bounded on the west by Block 131, bounded on the east by Block 132, as said blocks and streets are shown on a mad designated as "City of Bakersfield" recorded November 25, 1898, in the office of the County Recorder of said Kern County, and bounded on the southeast by the northwesterly right-of-way line of Freeway Route 178. Reserving therefrom, the westerly 36.25 feet for Public Utility Easement purposes. 2. That "P" Street between Freeway Route 178 and 25th Street, be and the same is hereby closed up, vacated and abandoned for public street purposes, subject to and in conformity with the reservations and exceptions contained in and contemplated by said Resolution of Intention No. 932. Reference to said Resolution of Intention is hereby made for further particulars. 3. That the City Clerk shall certify to the passage of this Resolution and shall cause a certified copy hereof, attested by the Clerk under the seal of the City, to be recorded in the office of the County Recorder of the County of Kern, California. o0o.
