HomeMy WebLinkAboutRES NO 36-78RESOLUTION NO. 36-78 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD ORDERING THE VACATION OF THE ALLEY IN BLOCK 355, BETWEEN "H" AND EYE STREETS, NORTH OF 14TH STREET, IN THE CITY OF BAKERSFIELD. WHEREAS, on the 15th day of March, 1978, the Council of the City of Bakersfield, pursuant to the provisions of.the "Street Vacation Act of 1941," being DiVision 9, Part 3, of the Streets and Highways Code of the State of California, passed and adopted its Resolution of Intention No. 930, declaring its intention to order the vacation of the alley in Block 355, between "H" and Eye Streets, north of 14th Street, in the .City of Bakersfield, County' of Kern, State of California; and WHEREAS, said Council did fix a time and..pl~ce for hear- ing all persons interested in or objecting to said proposed vacation, which said hearing was held on the 12th day of April, 1978, after notices were duly posted as required by law; and WHEREAS, this Council after duly considering the matter', does hereby find and resolve as follows: 1. That the alley in Block 355, between "H" and Eye Streets, north of 14th Street, in the City of Bakersfield, County of Kern, State of California, more particularly described as follows, is unnecessary for present or prospective public street purposes: A parcel of land situate in the City of Bakersfield, County of Kern, State of California, being a portion of Section 30, Township 29 South, Range 28 East, M.D.B.& M., and more particularly described as follows: All of the alley of 33.00 feet in width in Block 355, as said Block is shown on a Map of the City of Bakersfield, filed in the office-of the County Recorder of said Kern County on November 25, 1898. EXCEPTING AND RESERVING all of said alley for Public Utilities Easement purposes. Containing'0.20 acres, more or less. 2. That said alley in Block. 355, between "H" and Eye Streets, north of 14th Street, be and the same is hereby closed up, vacated and abandoned for public street purposes, subject to and in conformity with the reservations and exceptions contained in and contemplated by said Resolution of Intention No. 930. Refer- ence to said Resolution of Intention is hereby made for further particulars. 3.
