RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AUTHORIZING FILING OF APPLICATION
AND VERIFYING THAT SUFFICIENT FUNDS ARE AVAIL-
ABLE AND THAT ALL .OTHER MATTERS PREREQUISITE
TO AWARDING THE CONTRACT FOR A GRADE SEPARA-
TION ON TRUXTUN AVENUE AT THE ATCHISON, TOPEKA
AND SANTA FE RAILWAY COMPANY TRACK IN THE CITY
OF BAKERSFIELD WILL BE UNDERTAKEN.
WHEREAS, Section 2456 of the Streets and Highways Code
of the State of California requires' that local agencies requesting
separation projects furnish evidence that sufficient funds from
the local agency are available and that all other matters pre-
requisite to awarding the construction contract within a period
of one year have been or can be taken care of within that.time;
and
WHEREAS, the 1977-78 fiscal year budget approved
June 22, 1977, by the Council provides for the City of Bakersfield's
share of the funds necessary to construct the grade separation
structure on Truxtun Avenue at The Atchison, Topeka and Santa Fe
Railway Company's track (Public Utilities Commission Crossing
No. 2-889.4-B) in the City of Bakersfield from the monies made
available through Federal Aid Urban funds; and
WHEREAS, the City of Bakersfield will obtain all neces-
sary orders from the Public Utilities Commission of the State of
California, execute all necessary agreements with The Atchison,
Topeka and Santa Fe Railway Company, acquire all necessary
rights-of-way or obtain an order of the court granting to said
City of Bakersfield the immediate possession thereof, and accom-
plish all other requirements prerequisite to awarding a contract
for the construction of the grade separation structure on Truxtun
Avenue at The Atchison, Topeka and Santa Fe Railway Company's tract
(Public Utilities Crossing No. 2-889.4-B) in the City of Bakersfield
within a period of one year after the date that the California
Transportation Commission of the State of California and the
Department of Transportation of the State of California have
made an allocation of funds to said construction project.
NOW, THEREFORE, BE IT RESOLVED, by the Council of the
City of Bakersfield, as follows:
1. That sufficient funds are available in the adopted
City of Bakersfield 1977-78 fiscal year budget; and
2. That the City of Bakersfield intends to award the
contract for. the construction of said Grade Separation structure
on Truxtun Avenue at The Atchison, Topeka. and Santa Fe Railway
Company's track in the City of Bakersfield, no later than one
year after the date that the California Transportation Commission
of the State of California and the Department of Transportation
of the State of California have made an allocation of funds to
said construction project; and
3. Authorizes J. Dale Hawley, City Public Works
Director, as agent of the City to conduct all negotiations,
execute and submit all documents including but not limited to
applications, agreements, amendments, payment requests, etc.
which may be necessary for completion of the aforementioned pro-
ject.

I HEREBY CERTIFY that the foregoing Resolution was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on the, 29th day of March , 1978, by
