HomeMy WebLinkAboutRES NO 19-78 RESOLUTION N0. ,19-78 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD ORDERING THE VACATION OF PLANZ ROAD BETWEEN ASHE AND WILSON ROADS, IN THE CITY OF BAKERSFIELD. WHEREAS, on the 1st day of February, 1978, the Council of the City of Bakersfield, pursuant to the provisions of the "Street Vacation Act of 1941," being Division 9, Part 3, of the Streets and Highways Code of the State of California, passed and adopted its Resolution of Intention No. 928, declaring its intention to order the vacation of Planz Road between Ashe and Wilson Roads, in the City of Bakersfield, County of Kern, State of California; and WHEREAS, said Council did fix a time and place for hearing all persons interested in or objecting to said proposed vacation, which said hearing was held on the 22d day of February, 1978, after notices were duly posted as required by law; and WHEREAS, this Council after duly considering the matter, does hereby find and resolve as follows: 1. That Planz Road between Ashe and Wilson Roads, in the City of Bakersfield, County of Kern, State of California, more par- ticularly described as follows, is unnecessary for present or pro- spective public street purposes: All that portion of Fraser Road (Planz Road), of 60 feet in width, situate in the City of Bakersfield, County of Kern, State of California, being a portion of Sections.10 and 15, Township 30 South, Range 27 East, M.D.B.M. and more particularly described as follows: The south 30 feet of the west halfof said Section 10, excepting the west 55 feet and the east 90 feet; and The north 30 feet of the west half of said Section 15, excepting the west 55 feet and the east 90 feet. Containing 3.44 acres, more or less. 2. .That said Planz Road between Ashe and Wilson Roads, be and the same is hereby closed up, vacated and abandoned for public street purposes, subject to and in conformity with the reservations and exceptions contained in and contemplated by said Resolution of Intention No. 928. Reference to said Resolution of Intention is hereby made for further particulars. 3. That the City Clerk shall certify to the passage of this Resolution and shall cause a certified copy hereof, attested by the Clerk under the seal of the City, to be recorded in the office of the County Recorder of the County of Kern, California. o0o I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the Council of the City of Bakersfield at a regular meeting thereof held on the 22d day of February, 1978, by the follow- ing vote: AYES: COUNCILMEN BARTON, CHRISTENSEN, MEDDERS, PATTY', ROGERS, SCEALE,S, STRONG NOES:.
