HomeMy WebLinkAboutRES NO 16-78RESOLUTION NO. 16-78 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD SETTING DATE AND PLACE OF PUBLIC HEARING IN MATTER OF PROPOSED CANCELLATION OF LAND USE CONTRACT WITH RESPECT TO PART OF LAND, UNDER THE WILLIAMSON ACT AND DIRECTING CITY CLERK TO GIVE NOTICE IN ACCORD WITH SECTION 51284 OF THE GOVERNMENT CODE. WHEREAS, Oildale Ready Mix, a partnership, on February 15, 1978, filed with this Council, a petition for cancellation of a Land Use Contract as to part of the subject land, which contract was entered into under the Land Conservation Act of 1965 (Williamson Act), and which land is located in County of Kern Agricultural Preserve No. 14. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. That in accordance with the provisions of the Williamson Act, a public hearing on the Petition of Oildale Ready Mix is hereby set for Wednesday, the 22nd day of March, 1978, at the hour of 8 P.M., or as soon thereafter as the matter may be heard, at the Council Chambers in City Hall, 1501 Truxtun Avenue, Baker~field, California; and 2. That the City Clerk is hereby directed to give notice of the hearing in accordance with Section 51284 of the Government Code; and 3. That the notice as aforesaid shall be in substantially the following form: NOTICE OF PUBLIC HEARING In the Matter of Proposed Cancellation of Land Use Contract with Respect to Part of Land, Under the Williamson Act. NOTICE IS HEREBY GIVEN that the Council of the City of Bakersfield has fixed Wednesday, the 22nd day of March, 1978, at the hour of 8 P. M.,.or as soon thereafter as the matter may be heard, at the Council Chambers in City Hall, 1501 Truxtun Avenue, BakerSfield, California, as the time and place for a public hearing on the matter of the petition filed by Oildale Ready Mix, for cancellation of a Land Use Contract with respect to a portion of the land under such contract, dated February 23, 1968, and recorded in Official Records in Book 4135 at Page 470, Kern County Recorder's Office. The land for which cancellation is sought consists of approximately 42 acres located in Agricultural Preserve No. 14, located in the City of Bakersfield since annexation thereof in 1977, and more particularly described in Exhibit "~' attached hereto and incorporated herein by such reference as though fully set forth. Said petition is on file with the City Clerk of the City of Bakersfield at City Hall, 1501'Truxtun Avenue, Bakersfield, California, and may be examined by any interested person during regular office hours. Said hearing will be held and conducted pursuant to the provisions of Government Code Sections 51280 - 51285. The owner of any property located in the City in 'which AgricUltural Preserve No. 14 is situated may protest such cancellation. Dated this 22nd~ day of February, 1978. of the Council of the City of Bakersfield LEGAL DESCRIPTION A portion of the Southwest Quarter, Section 6, Township 29 South, Range 29 East, MDB&M, more particularly described as follows: Beginning at a point being the West quarter corner of said Section; thence easterly along center line a distance of 1320 feet, thence South 18° 30' West a distance of 2200 feet to a point; thence West parallel to the center line a distance of 660'; thence North along the West line 2000' to the point of beginning and containing 42 acres, more or less.
