HomeMy WebLinkAboutRES NO 11-78RESOLUTION NO. 11-78 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD ORDERING THE VACATION OF THE ALLEY IN BLOCK 99 BETWEEN MILLER AND HALEY STREETS, NORTH OF 21ST STREET AND SOUTH OF SUMNER STREET, IN THE CITY OF BAKERSFIELD. WHEREAS, on the 4th day of January, 1978, the Council of the City of Bakersfield, pursuant to the provisions of the "Street Vacation Act of 1941," being Division 9, Part 3, of the Streets and Highways Code of the State of California, passed and adopted its Resolution of Intention No. 925, declaring its intention to order the vacation of the alley in Block 99 between Miller and Haley Streets, north of 21st Street and south of Sumner Street, in the City of Bakersfield, County of Kern, State of California; and WHEREAS, said Council did fix a time and place for hearing all persons interested in or objecting to said proposed vacation, which said hearing was held on the 1st day of February, 1978, after notices were duly posted as required by law; and WHEREAS, this Council after duly considering the matter, does hereby find and resolve as follows: 1. That the alley in Block 99 between Miller and Haley Streets, north of 21st Street and south of Sumner Street, in the City of Bakersfield, County of Kern, State of California, more par- ticularly described as follows, is unnecessary for present or pro- spective public street purposes: A parcel of land situate in the City of Bakersfield, County of Kern, State of California, being a portion of Section 28, T29S, R28E, M.D.B.& M. and more par- ticularly described as follows: All of the alley of gQ feet in width in Block 99, as said Block 99 is ~own on a map designated as '~ap of Kern, Kern County, California" recorded April 10, 1893, in Book 1 of Maps, Page 53, in the office of the County Recorder of said Kern County. Excepting and reserving all of said alley for Public Utility Easement purposes. Containing .184 acres, more or less. 2. That said alley in Block 99 between Miller and Haley Streets, north of 21st Street and south of Sumner Street, be and the same is hereby closed up, vacated and abandoned for public street purposes, subject to and in conformity with the reserva- tions and exceptions contained in and contemplated by said Resolu- tion of Intention No. 925. Reference to said Resolution of Inten- tion is hereby made for further particulars. 3.
