HomeMy WebLinkAboutRES NO 114-77RESOLUTION NO. ~]4-7~ A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD CERTIFYING THAT THE INFORMATION CONTAINEDwIN THE INITIAL STUDY WITH RESPECT TO THE'PROPOSED JOINT DEVELOPMENT AGREEMENT BETWEEN THE BAKERSFIELD REDEVELOPMENT AGENCY AND METRO PLAZA, INC. HAS BEEN REVIEWED AND CONSIDERED; FINDING THAT THE IMPLEMENTATION OF SAID AGREE- MENT WILL NOT HAVE A SIGNIFICANT EFFECT ON THE ENVIRONMENT; FINDING THAT THE CONSIDERATION FOR THE LEASE OF THE PROPERTY THEREUNDER IS NOT LESS THAN FAIR MARKET RENTAL VALUE IN ACCORDANCE WITH COVENANTS AND CONDITIONS GOVERNING SUCH LEASE; AND APPROVING THE LEASE OF SUCH PROPERTY AND SAID JOINT DEVELOPMENT AGREEMENT. WHEREAS, the Bakersfield Redevelopment Agency (the "Agency") is engaged in activities necessary to execute and implement the Redevelopment Plan for the Downtown Redevelopment Project (the "Project"); and WHEREAS, in order to implement the Redevelopment Plan, the Agencyproposes to lease certain real property (the '~Property") in the Project area pursuant to the terms and provisions of a Joint Development Agreement (the "Agreement") and which property is described in the attached Exhibit "A" and incorporated herein by reference; and WHEREAS, Metro Plaza, Inc. (the "Developer") has submitted to the Agency a written offer in the form of said Agreement to lease the property for not less than fair market value for uses in accordance with the Redevelopment Plan, and the covenants and conditions of said Agreement; and WHEREAS, the proposed Agreement contains all the pro- visions, terms and conditions and obligations required by State and local law; and WHEREAS, Developer possesses the qualifications and financial resources necessary to insure development of the Property in accordance with the purposes and objectives of the Redevelopment Plan; and WHEREAS, the Agency has prepared a summary setting forth the cost of the Agreement to the Agency, the estimated value of the interest to be leased determined at the highest uses permitted under the Redevelopment Plan, and the rental amount and has made said summary available for public inspection in accordance with the California Community Redevelopment Law; and WHEREAS, the Agency has prepared an Initial Study of Environmental Impact with respect to said Agreement and has found and determined that the implementation of said Agreement will not have a significant effect on the environment; and WHEREAS, pursuant to provisions of the California Community Redevelopment Law, the Agency and the City Council of the City of Bakersfield ("City Council") held a joint public hearing on the proposed lease of the Property and said proposed Agreement after publication of notice as required by State Law; and WHEREAS, the City Council has duly considered all terms and conditions of the proposed lease and believes that the redevelopment of the Property pursuant to the proposed Agreement is in the best interests of the City and the health, safety, morals and welfare of its residents, and in accord with the public purposes and provisions of applicable State and local law and requirements. NOW, THEREFORE, BE IT RESOLVED THAT: 1. The City Council hereby certifies that the information contained in the Initial Study has been reviewed and considered by the members of the City Council. 2. The City Council hereby finds and determines that: (a) No substantial changes are proposed in the Redevelopment Project, or with respect to the circumstances under which the Project is to be undertaken, which will require major revisions in the Environmental Impact Reports previously adopted for the Project due to the involvement of new environmental impacts not covered in said previous Environmental Impact Reports; (b) No subsequent or Supplement to EIR is necessary or required; and (c) The proposed action will have no significant effect on the environment, except as identified and considered in the previous EIRs. 3. The City Council hereby finds and determines that the consideration for the lease of the Property pursuant to said Agreement is not less than fair market rental value in accordance with covenants and conditions governing such lease. 4o The lease of the Property by the Agency to Metro Plaza, Inc. and the Agreement which establishes the terms and conditions for the lease and development of the Property are hereby approved.
