A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD PROVIDING FOR THE CONSOLIDATION
OF CITY OF BAKERSFIELD ANNEXATION ELECTION
WITH THE KERN UNION HIGH SCHOOL REVENUE
LIMIT INCREASE ELECTION TO BE HELD ON TUESDAY,
MARCH 7, 1978.
WHEREAS, Section 23300 of the Elections Code of the State
of California provides that whenever two or more elections of any
public district or city are called to be held on the same day in
territory that is in part the same, they may be consolidated pursuant
to Chapter 4, Part 2 of Division 14 (corr~r~encing with Section 23300)
of the Elections Code, upon the order of the governing bodies calling
the elections; and
WHEREAS, the Council of the City of Bakersfield, by
Resolution No. 92-77, has called a special election to be held on
Tuesday, the 7th day of March, 1978, for the purpose of submitting
to the qualified-electors residing in Kern City, comprising Kern
County election precinct Kern City 1 and Kern City 2, Portion 1
(portion 1 being that portion of'Kern City 2 located within the
territory proposed to be annexed) the question of whether or not said
territory designated and identified as "KERN CITY," shall be annexed
to the City of Bakersfield and whether the property in the territory
proposed to be annexed shall be, after such annexation, subject to
taxation equally with the property within the City of Bakersfield, to
pay the bonded indebtedness of the City of Bakersfield outstanding
for the acquisition, construction or completion of municipal improve-
ments; and
WHEREAS, the Kern Union High School District has called a
Revenue Limit Increase Election to be held on Tuesday, the 7th day
of March, 1978, in territory that is in part the same as for the said
City annexation election, to wit in territory including all of Kern
County precincts Kern City 1 and Kern City 2; and
WHEREAS, it is the desire of this council to consolidate
the said City Annexation Election with the Kern Union High School's
Revenue Limit Increase Election, both of which are called to be held
on the same day, and in territory that is in part the same, as herein-
before described, and with any and all other elections that may be
held on the same day within territory that is in part the same.
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Bakersfield as follows:
1. That the Special Election for the "Kern City" Annexation,
called by the Council of the City of Bakersfield for Tuesday, March 7,
1978, is hereby ordered consolidated with the Revenue Limit Increase
Election called by the Board of Trustees of the Kern Union High School
District for the same day, as to Kern County Precinct Kern City 1 and
Kern City 2, Portion 1 (portion 1 being that portion of precinct Kern
City 2 located within the territory proposed to be annexed; portion 2
of precinct Kern City 2 being excluded from said consolidation as being
an island of unincorporated territory not included in the territory
proposed to be annexed); and that the said annexation election is also
consolidated'with any and all other elections that may be held on the
same day within territory that is in part the same.
2. That at the election there shall be submitted to the
qualified electors within the territory comprising precinct Kern City
1 and Kern City 2, Portion 1, the following proposition:
SHALL KERN CITY BE ANNEXED TO THE CITY OF BAKERSFIELD
AND THE PROPERTY IN SUCH TERRITORY BE, AFTER SUCH
ANNEXATION, SUBJECT TO TAXATION EQUALLY WITH THE
PROPERTY WITHIN THE CITY OF BAKERSFIELD, TO PAY THE
BONDED INDEBTEDNESS OF THE CITY OF BAKERSFIELD OUT-
STANDING, FOR THE ACQUISITION, CONSTRUCTION OR COM-
PLETION OF MUNICIPAL IMPROVEMENTS?
3. That within the territory described in paragraph 2
(the territory affected by this order of consolidation), the election
precincts, polling places, voting:booths and election officers for said
Annexation Election shall be the same as those provided for the Revenue
Limit Increase Election within such territory and the election shall
be held as if there were only one election and only one form of ballot
shall be used.
4~ The County Clerk of the County of Kern is hereby
authorized to canvass the returns of the said annexation election and
shall certify the results of the canvass of said returns to the Council
of the City of Bakersfield, who shall thereupon declare the results
thereof.
5. The City Clerk is hereby directed to transmit and file
certified copies of this resolution with the County Clerk of the
County of Kern and the Clerk of the Board of Trustees of the Kern
Union High School District.

I HEREBY CERTIFY that the foregoing resolution was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on the 14th day of December, 1977, by the
following vote:
