HomeMy WebLinkAboutRES NO 112-82RESOLUTION NO. 112'82 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD ORDERING THE VACATION OF A PORTION OF BROWN STREET BETWEEN MONTEREY STREET AND NILES STREET IN THE CITY OF BAKERSFIELD. WHEREAS, on the 18th day of August, 1982, the Council of the City of Bakersfield, pursuant to the provisions of the "Street Vacation Act of 1941," being Division 9, 'Part 3, of the Streets and Highways Code of the State of California, passed and adopted its Resolution of Intention No. 958 declaring its intention to order the vacation of a portion of Brown Street between Monterey Street and Niles Street in the City of Bakersfield, County of Kern, State of California; and WHEREAS, said Council did fix a time and place for hearing all persons interested in or objecting to said proposed vacation, which said hearing was held"~o.~ the 15th day of September, 1982, after notices were duly posted as required by law; and WHEREAS, this Council after duly considering the matter, does hereby find and resolve as follows: 1. That a portion of Brown Street between Monterey Street and Niles Street in the City of Bakersfield, County of Kern, State of California, more particularly described in Exhibit "A" attached hereto and made a part hereof, is unnecessary for present or prospective public street purposes. 2. That a portion of Brown Street between Monterey Street and Niles Street be and the same is hereby closed up, vacated and abandoned for public street purposes, subject to and in conformity with the reservations and exceptions contained in and contemplated by said Resolution of Intention No. 958. Reference to said Resolution of Intention is hereby made for further particulars. 3. That the City Clerk shall certify to the passage of this Resolution and shall cause a certified copy hereof, attested by the Clerk under the seal of the City, to be recorded in the office of the County Recorder of the County of Kern, California. .o0o- I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the Council of the City of Bakersfield at a regular meeting thereof held on the 15th day of September, 1982, by the following vote: AYES: COUNCILMEN: BARTON, CHRISTENSEN, ME'ANS, PAYNE, PATTY, ROCKOFF, ABSTAINING: COUNCILMEN: STRONG Council of the f Bakersfield APPROVE2T~&:~S 15t-h"d:a~z'of September, 1982 ~' of Bakersfield APPROVED as to form: CIT~~o~ City ~f Bakersfield the VACATION OF A PORTION OF BRO~qq STREET BETWEEN NILES STREET AND MONTEREY STREET A parcel of land situated in the City of Bakersfield, County of Kern, State of California, being a portion of Section 28, Township .29 South, Range 27 East-, M.D.B. & M., more particularly described as follows: Beginning a~ .the northeast corner of Block 32 as said Block is shown on the Map of'Kern recorded April 10, 1893 in Map Book 1 at page S3 in the Office of the Kern County Recorder, said northeast' comer being the intersection of the south right of way line of Niles Street (formerly N Street) and the west right of'way line of Brown Street, and also being the Point of Beginning for this description; THENCE (1) South 16° 17' 47" West along the West right of way line of Brown Street a distance of 140 feet; THENCE (2) North 47° 30' 00" East a distance of 71.623 feet to a point on a tangent curve concave to the northwest having a radius of 20 feet; THENCE (3) NOrtheasterly along the last named curve through a central angle of 31°'12' 13" an arc length of 10.892 feet to a point on the centerline of Brown Street; THENCE (4) North 16° 17' 47" East along the last named centerline a distance of 48.382 feet to a point on a tangent curve concave to the southwest having a radius of 20 feet; THENCE (S) Northwesterly along the last named curve through a c~ntral angle of 90* 00~ 47" an arc length of 31.420 feet to a point on the easterly prolongation of the south right of way line of Niles Street; THENCE (6) North 73~ 43' 00" West along the last named prolongation of the south right of way line of Niles Street a 'distance of 19.996 feet to the Point of Beginning.
