HomeMy WebLinkAboutRES NO 90-82ESOLUTION NO. 90-8P, RESOLUTION OF THE CITY COUNCIL ORDERING CERTAIN CHANGES AND MODIFICATIONS TO THE ENGINEER'S "REPORT" IN A SPECIAL ASSESSMENT DISTRICT WHEREAS, the CITY COUNCIL of CITY OF BAKERSFIELD, CALIFORNIA, has' previously adopted its Resolution of Intention pursuant to the provisions of the "Municipal Improvement Act of 1913", being Division 12 of the Streets and Highways Code of the State of California, for the construction of certain works of improvement in a special assessment district known and designated as ASSESSMENT DISTRICT NO. 81-1 (hereinafter referred to as the "Assessment District"); and WHEREAS, subsequent thereto, the City Council did, by 'Resolution, approve the "Report" and call for sealed bids on the construction of the works of improve- ment as contemplated in said AsSessment District; and, WHEREAS, prior to said Public Hearing, sealed bids were received and consi- dered for the construction of the works of improvement in the Assessment District, and at this time an amended assessment roll has been presented show- ing modifications and reductions in all assessments because of the favorable construction bid so received; and, WHEREAS, at this time bids have also been received for the sale of bonds; and, WHEREAS, it now appears that the changes and modifications as set forth in the amended assessment roll as presented herein should be approved and ordered to be done. NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS: SECTION 1. That the above recitals are all true and correct. SECTION 2. That it is hereby ordered that the changes and modifications as set forth in the amended assessment. roll- as-presented herein, based on the bids received, are hereby approved and ordered to be done. SECTION 3. That said changes and modifications above mentioned are hereby ordered pursuant to the authority as set forth in Section 10352 of the Streets and Highways Code of the State of California (the "Municipal Improvement Act of 1913"). SECTION 4. That the Englneer's "Report", the Assessment l, and all related documentation, as so modified, are all for the best interests of the property owners within the Assessment District, and said assessment, as modified and apportioned, is in accordance with the benefits received, and the "Report", as herein modified and amended, shall stand as the "Report" for all subsequent proceed- ings relating to this Assessment District. ABSENT: COUNCILMEN: _ ABSTAINING: COUNCILMEN: :-,~ ~-L~ ,--, APP ED ~:~ 20th day~o~, LDF~- ' -' ' E '~F ' '~H CITY CL F E COUNCIL OF THE CITY OF BAKERSFIELD APPROVED AS TO FORM: KERSFT R IELD AMENDED ENGINEER'S REPORT MUNICIPAL IMPROVEMENT ACT OF 1913 CITY OF BAKERSFIELD for ASSESSMENT DISTRICT NO. 81-1 [FAIRVIEW) 1982 WILLDAN ASSOCIATES ENGINEERS PLANNERS 290 South Anaheim Blvd. Anaheim0 Calif. 92805 The following changes have been made to the Engineer's Report as originally submitted: 1) The construction costs have been reduced from $566,085 to $501,535.37 to reflect the actual bids received. 2) The costs of printing, posting, publishing has been increased from $5,000 to $10,000 on advise of the financial underwriters. 3) The project contingency fund has been reduced from $52,727 to $50,464.63 due in part to the reduced construction costs; also the State tax will not be required. 4) The financing costs have been reduced from $237,221 to $159,875.78 as the result of receiving the actual purchase price commitment from the bond underwriter. This reflects the general lowering of the interest rates. 5) These changes were distributed proportionally to the various parcels based upon the assessments set forth in the preliminary report. The assessments for assessment parcels 6 and 7 were reduced an addi- tional 10% as the result of the greater difficulty in developing these parcels as reflected in subsequently received appraisal reports.
