Home My WebLink AboutRES NO 70-82RESOLUTION NO. 70-82 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD REGARDING TRANSFERS OF PROPERTY TAX REVENUES UPON CITY OF BAKERSFIELD ANNEXATIONS FILED AFTER JANUARY 1, 1979 BUT BEFORE JULY 24, 1979. WHEREAS, pursuant to the provisions of Revenue and Taxation Code Section 99(e), as enacted by Stats. 1979, Chapter 282 ("AB 8"), amended by Stats. 1979, Chapter 1161, and amended and renumbered by Stats. 1980, Chapter 801, any annexation which was filed with the State Board of Equalization after January 1, 1979 but before July 24, 1979 (the effective date of AB 8) was entered on the 1980-81 Property Tax Roll of the County; but the County Auditor-Controller was required, and did impound all revenues accruing to the local agencies affected by such annexation from the annual tax increment attributable to the tax rate area(s) comprising the annexed territory until those local agencies determine by resolution the amount of property tax revenues which should be exchanged between those agencies by reason of the an- nexation; and WHEREAS, the purpose of this resolution is to reflect and approve the negotiations which have taken place between the County Administrative Officer and the City Manager of the City of Bakersfield as to the property tax revenues which should be transferred from the County of Kern to the City of Bakersfield as a result of the certain annexations listed herein, which were filed with the State Board of Equalization after January 1, 1979 but before July 24, 1979, and so came within the aforesaid pro- visions of Revenue and Taxation Code Section 99(e). NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. Subject to the adoption of a concurring resolution by the Board of Supervisors of the County of Kern, the County Auditor-Controller is hereby directed to release such funds as may be impounded pursuant to the provisions of Revenue and Taxation Code Section 99(e) relating to the above-listed annexations, and to effect the above-listed transfers of property tax revenues in the apportionment of property taxes for 1982-83 and following fiscal years. 3.
