A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD REGARDING TRANSFERS OF PROPERTY
TAX REVENUES UPON CITY OF BAKERSFIELD
ANNEXATIONS FILED AFTER JANUARY 1, 1978 BUT
ON OR BEFORE JANUARY 1, 1979.
WHEREAS, pursuant to the provisions of Revenue and
Taxation Code Section 99(e), as enacted by Stats. 1979, Chapter
282 ("AB 8"), amended by Stats. 1979, Chapter 1161, and'amended
and renumbered by Stats. 1980, Chapter 801, any annexation which
was filed with the State Board of Equalization after January 1,
1978 but on or before January 1, 1979 was entered on the 1979-80
Property Tax Roll; and 1979-80 property tax revenues were computed
and allocated in accordance with Revenue and Taxation Code Sections
96, 97.5(f) and 98(f) to those local agencies with jurisdiction
in each tax rate area on the basis of each local agency's total
1978-79 tax allocation, apportioned among its component tax rate
areas in the percentages the taxable assessed valuation in each
component tax rate area represented of the agency's total taxable
assessed valuation. In effect, 1979-80 property taxes were ap-
portioned to each local agency on the basis of its then-current
jursidictional responsibility, as reflected in the 1979-80 Property
Tax Roll. However, notwithstanding the aforesaid actual apportion-
ment, the County Auditor-Controller was required by the aforesaid
Revenue and Taxation Code Section 99(e), and did impound all
revenues accruing to local agencies affected by annexations
enrolled on the 1979-80 Property Tax Roll from the annual tax
increment attributable to the tax rate area(s) comprising the
annexed territories until those local agencies determine by
resolution the amount of property tax revenues which should be
exchanged between those agencies by reason of such annexations;
and
WHEREAS, the purpose of this resolution is to reflect
and approve the mutual understanding between the County Adminstra-
tive Officer and the City Manager of the City of Bakersfield that
in fact 1979-80 property tax revenues were apportioned among
local agencies on the basis of their then-current respective
jurisdictional responsibilities, including transfers of responsibilities
effected by annexations enrolled on the 1979-80 Property Tax
Roll; and, accordingly, that no property tax revenues should be
exchanged between the County of Kern and the City of Bakersfield
as a result of the certain annexations listed herein, which were
filed with the State Board of Equalization after January 1, 1978
but on or before January 1, 1979, and so came within the aforesaid
provisions of Revenue and Taxation Code Section 99(e).
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Bakersfield as follows:
1. It is hereby determined that there should be no
transfers of property tax revenues between the County of Kern and
the City of Bakersfield within the component tax rate area(s) by
reason of the below-listed annexations:

2. Subject to the adoption of a concurring resolution
by the Board of Supervisors of the County of Kern, the County
Auditor-Controller is hereby directed to release such funds as may
be impounded pursuant to the provisions of Revenue and Taxation
Code Section 99(e) relating to the above-listed annexations.
3. The Clerk of the City of Bakersfield is hereby
directed to inform the Board of Supervisors of the County of Kern
and the Kern County Auditor-Controller of the determination set
forth herein by transmittal to them of certified copies of this
resolution.

I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at a
regular meeting thereof held on the 7th day of July, 1982, by the
following vote:
