HomeMy WebLinkAboutRES NO 68-82RESOLUTION NO. 68-82 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD ESTABLISHING POLICY FOR GRANTING DENSITY BONUS INCENTIVES TO DEVELOPERS OF HOUSING FOR LOW- OR MODERATE-INCOME FAMILIES. WHEREAS, Section 65915 of the Government Code requires that when a developer of housing agrees to construct at least twenty- five percent (25%) of the total units of a housing development for persons and families of low- or moderate-income, the City must enter into an agreement with the developer to either grant a density bonus of twenty-five percent or provide two other bonus incentives for the project; and WHEREAS, the Planning Commission has reviewed this provision of State Law and made recommendations to the City Council concern- ing certain minimal policies to be applied in the implementation of Section 65915 of the Government Code; and WHEREAS, the City Council has further reviewed the law and Planning Commission recommendations pertaining thereto. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield that the following policies and procedures shall apply to projects for which density bonuses or other incentives are requested: 1. It is the developer's responsibility to offer 25 percent or more of the resi- dential units in a development for low- or moderate-income families and request a density bonus or other development incentives. The department and/or commission which receives an application to develop using the program shall condition all reviews and approvals upon final approval of a contract with the developer therefore by the City Council. of the Council of the City of Bakersfield AppROV~ED-~t~is 7th day of July, 1982 APPROVED 'as -~t~~ 'form: ld -2- 3. The department and/or commission review- ing applications to develop using this program shall evaluate the impacts of 25 percent increase in density and the costs of other incentives which could be used instead of t~e density bonus. These are to be reported with the recom- mended agreement to the City Council. 4. An enforceable agreement between the City and developer must be entered into to guarantee that 25 percent of the units in the development are made avail- able for low- and moderate-income families. 5. The residential units, whether for rental or sale, or resale, shall be re- served for low- and moderate-income families for a period of five years from the date of first occupancy. 6. The Community Development Department shall monitor compliance with agreements entered into pursuant to this program.
