HomeMy WebLinkAboutRES NO 41-82RESOLUTION N0. 41-82- A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD ~EREIN THE COLrNCIL AGREES TO CONSIDER IN CONCEPT THE USE OF REDEVEI,OPMENT AGENCY TAX' INCREMENTS FOR CERTAIN IMPROVEMEntS ON THE AUDITORIUM_. ~!ADF NECESSARY BY THE DEVELOP- MFNT OF THE PROPOSED CO~VE~TION CENTER HOTEL. WHEREAS, the City Council has the basic responsibility for protecting the public and economic welfare of the community as a who le; and WHEREAS, the City Council has embraced the concept of a Convention Center Hotel proposed for the Downtown Redevelopment Project area; and WHEREAS, the City Coundil has approved the proposed site for the Convention Center Hotel as being the most viable location for a facility of this nature; and .k~EREAS, the City Council has approved and adopted the Disposition and Development Agreement between the hotel developer and the Redevelopment Agency for the City of Bakersfield; NOW, THEREFOPS, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The City Council agrees to consider the use of tax increment funds generated by the Downtown Redevelopment Project for the replacement of existing storage facilities of the auditorium presently located on the proposed Hotel site,' the removal of which is necessitated by the development of the 'proposed Convention Center Hotel. 2. The City Council dir'ects staff to include within its planning, necessary modifications to the entrances' and circulation of the auditorium and arena complex for the'purpose 'of handicap access. This consideration is in compliance with numerous requests from handicap organizations and citizens and the belief that in establishing a Convention Center complex, the subject complex, should be accessible to all citizens of Bakersfield. 3. The City Council directs staff to prepare the necessary summaries' and economic data pursuant to Sections 33445 and 33679 of the California Health and Safety Code '(California Redevelopment Law), and that such approval of this resolution is subject to satisfying all requirements of these SeCtions and any other applicable 'State Law. disclosed: 4. Within the summaries, the following data will be (a) Estimates of the amount of such taxes proposed to be used to pay for such land and construction of the proposed storage facilities including any and all intere'~.t payments. (b) The disclosure of all facts supporting the determi- nations required to be made by the legislative body pursuant to Section 33445 of the California Health and Safety Code. (c) Full discussion of the Redevelopment purpose for which such taxes are being used to pay for the construction of such publicly owned facilities. 5. The City Council directs staff to establish the time and place Of the public hearing required by State Law and directs staff to make available for public inspection and copying the summary which includes all the aforementioned data.
