RESOLUTION NO. 39-82
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
BAKERSFIELD MAKING LNVIRONMENTAL FINDINGS
NECESSARY FOR THE PROPOSED DISPOSITION AND
DEVELOPMENT AGREEMENT BETWEEN THE BAKERSFIELD
REDEVELOPMENT AGENCY AND BAKERSFIELD METROPOLITAN
ASSOCIATION FOR THE LEASE OF REAL PROPERTY LOCATED
IN THE DOWNTOWN BAKERSFIELD'REDEVELOPMENT PROJECT,
AND THE DEVELOPMENT OF SAID PROPERTY.
WHEREAS, the Bakersfield Redevelopment Agency ("Agency") proposes to enter
into a Disposition and Development Agreement ("Agreement") with Bakersfield
Metropolitan Association ("Developer") for the lease of certain real property
in the Project area and the development of a Convention Center Hotel; and
WHEREAS, on the basis of an Initial Study with respect to the proposed
Di~sposition and Development Agreement, the Agency determined that a Negative
Declaration properly addressed the environmental impacts of the proposed
development with respect to all applicable environmental issues; and
WHEREAS, the Agency has prepared and circulated a Negative Declaration
pursuant to the California Environmental Quality Act of 1970 ("CEQA") and
State and local guidelines and procedures; and
WHEREAS, a noticed joint public hearing has been held by the Agency and the
City Council on said Negative Declaration and on the proposed development and
Disposition and Development Agreement, at which time interested persons were
given an opportunity to be heard; and
WHEREAS, the City Council has reviewed and considered the information
contained in said Negative Declaration, and the environmental documents pre-
viously prepared with respect to the Downtown Bakersfield Redevelopment Plan
and the proposed regional retail center development, including a Final Environ-
mental Impact Report on the Downtown Bakersfield Redevelopment Project and the
Area Proposed to be Added to the Project adopted November 18, 1974, by Resolution
No. RA31-74, a Supplement to the Environmental Impact Report on the Second
Amendment to the Downtown Bakersfield Redevelopment Project, adopted on
August 17, 1976, by Resolution No. RA12-76, and a Subsequent Environmental Impact
Report, adopted on November 6, 1979, by Resolution No. RA6-79, which have pre-
viously been prepared and certified as required by law;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY'OF
BAKERSFIELD, AS FOLLOWS:
1. The City Council hereby certifies that the Negative Declaration has
been prepared and completed in compliance with CEQA and State and local
guidelines and procedures.
2. The City Council certifies that the information contained in the
Negative Declaration and previous environmental documents evaluating the
environmental effects of the Downtown Bakersfield Redevelopment Project and
the Convention Center Hotel have been reviewed and considered by the members
of the City Council.
3. The City Council hereby directs City staff to develop a strategy for
implementing the recommendations with respect to Fire, Safety and Circulation
contained in the Negative Declaration.
4. The City Council hereby finds and determines that all significant
environmental effects identified in the Negative Declaration have been reduced
to an acceptable level in that all significant environmental effects that can
feasibly be avoided have been eliminated or substantially lessened as determined
through findings set forth in Paragraph 3 of this Resolution.
