A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD ACCEPTING QUITCLAIM OF CANAL
EASEMENT AND GRANT OF CANAL EASEMENT FROM
TENNECO WEST, INC., AND AUTHORIZING AND
APPROVING QUITCLAIM OF CANAL EASEMENT AND
GRANT OF CANAL EASEMENT FROM CITY TO KERN
DELTA WATER DISTRICT RELATIVE TO EASEMENTS
FOR BUENA VISTA CANAL.
WHEREAS, do to an oversight, the 1976 conveyances from
Tenneco West, Inc., to the City of Bakersfield, and hence to the
Kern Delta Water District, did not include the easements for the
Buena Vista Canal through Section 30, Township 31 South, Range 26
East, M.D.M.; and
WHEREAS, Tenneco West has tendered to the City of Bakersfield
a Grant of Canal Easement across lands held.by Tenneco West in fee
(hereinafter referred to as the "Grant") and a Quitclaim of Canal
Easement acquired by the Kern County Land Company from Miller &
Lux for the remainder of the canal (hereinafter referred to as the
"Quitclaim"), which Grant and Quitclaim are attached hereto as
Exhibits "A" and "B" and incorporated herein by reference; and
WHEREAS, it is in the best interest of the parties and
in furtherance of their mutual intent as reflected in the 1976
conveyances that the City of Bakersfield accept such Grant and
Quitclaim from Tenneco West and convey such interests to the Kern
Delta Water District.
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Bakersfield that the aforementioned Grant and Quitclaim
are hereby accepted by the City of Bakersfield, that the conveyance
of the interests in real property thereby represented to the Kern
Delta Water District are hereby approved, and the Mayor and City
Clerk are authorized to execute such documents as may be necessary
or appropriate to effectuate such transfers.
I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at a
regular meeting thereof held on the 31st day of March, 1982, by the
following vote:
