HomeMy WebLinkAboutRES NO 10-82RESOLUTION NO. 10-82 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING RESOLUTION NO. 67-81, ESTABLISHING A RECORDS-RETENTION SCHEDULE FOR THE POLICE DEPARTMENT AND APPROVING DESTRUCTION OF RECORDS IN ACCORDANCE THEREWITH. WHEREAS, Section 34090.6 of the Government Code has been added to permit the destruction of twenty-four (24)-hour radio/telephone logging tapes after one hundred (100) days upon approval by the City Council and the written consent of the City Attorney; and WHEREAS, twenty-four (24)-hour radio/telephone logging tapes are of no value to the Police Department after one hundred (100) days; and WHEREAS, the Council, upon the request of the Chief of Police, desires to add to the retention schedule for records under the charge of the Police Department by amending Resolution No. 67-81 and to approve immediate destruction of twenty-four (24)-hour radio/telephone logging tapes in accordance therewith and the continued destruction of the listed items in accordance with such retention schedule. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: SECTION 1. That Paragraph VIII, Item 1, be added to Resolution No. 67-81 as follows: VIII. Retain 100 days: 1. Twenty-four (24)-hour radio/telephone logging tapes. o0o I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the Council of the City of Bakersfield at a regular meeting thereof held on the 3d day of February, 1982, by the following vote: AYES: COUNCILMEN: BARTON, CHRISTENSEN, MEANS, pAYNE, RATTY, ROCKOFF, STRONg NOES: COUNCILMEN: ABSENT: COUNCILMEN; ABSTAINING: COUNCILMEN: CITY x of Council of the City of Bakersfield the CI of Bakersfield CTS:mm 2. CONSENT OF CITY ATTORNEY Pursuant to Government Code section 34090.6, all twenty-four (24)-hour radio/telephone logging tapes of the Bakersfield Police Department which are one hundred (100) days old, and for which no hold has been placed pending either criminal or civil action, shall be destroyed, provided that any such recordings that are evidence in any claim filed or any pending litigation shall be preserved until pending litigation is resolved.
