HomeMy WebLinkAboutRES NO 2-82RESOLUTION NO. 2'82 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD CALLING THE SPECIAL MUNICIPAL ELECTION FOR THE PURPOSE OF SUBMITTING TO THE ELECTORS OF THE CITY AMENDMENT TO THE CHARTER OF THE CITY OF BAKERSFIELD, TO BE HELD ON TUESDAY, JUNE 8, 1982. WHEREAS, the Council of the City of Bakersfield proposes to submit a measure to amend the Charter of the City in the manner set forth in Chapter 3, Division 2 of Title 4 (commencing with Section 34450) of the Government Code of the State of California, at a Special Municipal Charter Amendment Election; and WHEREAS, the measure so proposed to be submitted to the electors of the City is as follows: City of Bakersfield Measure A Shall the Charter of the City of Bakersfield be amended to provide that the general municipal election of councilmembers be held in November rather than in March, except as may otherwise be provided by ordinance to coincide with school elections, and that the terms of councilmembers who took off'ice in March, 1979 be extended to November, 1983 and that the terms of council- members who took office in March, 1981 be extended to November, 19857 WHEREAS, at this time, Section 67 of the Charter reads as follows: Date of General Municipal Election Section 67. A general municipal election for the election of members of the Council shall be held on the first Tuesday after the first Monday in March in each odd-numbered year commencing in the year 1977. The persons having the highest number of votes given for each office shall be elected. The members of the Council elected shall hold office until their successors are elected and qualified. WHEREAS, at this time, Section 15 of the Charter reads as follows: Term of Office Section 15. Councilmen shall be elected for a term of four years and shall serve until their successors are elected or appointed and have qualified. WHEREAS, if a majority of the qualified voters voting on City of Bakersfield Measure A shall vote in favor of such measure, it shall be deemed ratified, and Sections 67 and 15 of the Charter of the City of Bakersfield shall, upon filing with the Secretary of State, be amended to read as follows: Date of General Municipal Election Section 67. A general municipal election for the election of members of the Council, and for such other purposes as the Council may prescribe, shall be held in the City of Bakersfield on the first Tuesday after the first Monday in November of each odd-numbered year, except as otherwise provided by ordinance of the Council to coincide with the Consolidated General District and School Governing Board Election. The person having the highest number of votes given for each office shall be elected. The elected members of the Council shall hold office until their successors are elected or appointed and qualified. Term of Office Section 15. Councilmembers shall be elected for a term of four (4) years and shall serve until their successors are elected or appointed and have qualified, commencing in the year 1983. The terms of Councilmembers who took office on March 19, 1979 shall be extended to the second regular Council meeting following the first Tuesday after the first Monday in November of 1983. The terms of Councilmembers who took office on March 16, 1981 shall be extended to the second regular Council meeting following the first Tuesday after the first Monday in November of 1985. Councilmember terms may be altered to coincide with the Consolidated General District and School Governing Board Election as may be provided by ordinance pursuant to Section 67 of this Charter. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. That the above-stated City of Bakersfield Measure to amend the Charter of the City of Bakersfield is hereby submitted for placement on the ballot in proper form to be used at the election hereby called. 2. That a Special Municipal Charter Amendment Election is hereby called to be held in the City of Bakersfield on Tuesday, the 8th day of June, 1982, for the purpose of submitting to the electors of said City the foregoing City of Bakersfield Measure A to amend the City Charter as aforesaid° 3. That it is the intent of this Council to file with the Board of Supervisors of Kern County a request for an order consolidating the Special Municipal Charter Amendment Election (in the form of a resolution) hereby called for June 8, 1982, with the State of California Direct Primary Election to be held on the same date, in accordance with Section 23302 of the Elections Code. 4. That the polls shall be open in all precincts in the City from 7:00 o'clock A.M. to 8:00 o'clock P.M. 5.
