HomeMy WebLinkAboutRES NO 59-80RESOLUTION NO. 59-80 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD FINDING THERE ARE NO UNMET PUBLIC TRANSPORTATION NEEDS WHICH COULD BE REASONABLY MET. WHEREAS, The Transportation Development Act of 1971 pro- vides for the disbursement of funds from the Local Transportation Fund held in trust by the Kern County Auditor-Controller for use by eligible claimants for the purpose authorized by Article 8, Section 99400(a) Streets and Roads and Article 4, Section 99260(a) Public Transportation; and WHEREAS, an eligible claimant wishing to receive an allo- cation from the Local Transportation Fund must receive written and oral testimony regarding transit needs and after considering the evidence presented at the meeting, and their own knowledge of public transportation needs within the City of Bakersfield, must find that transit needs are being met; and WHEREAS, a duly noticed public hearing was held before the City Council of the City of Bakersfield on July 16, 1980, wherein written and oral testimony regarding transit needs was received; and WHEREAS, the City Council considered the evidence pre- sented at the public hearing along with its knowledge of public transportation needs within the City of Bakersfield; and WHEREAS, funds from the Local Transportation fund will be required to maintain the street and road system. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BAKERSFIELD HEREBY FINDS AND DECLARES AS FOLLOWS: 1. That when Golden Empire Transit implements its proposed program there will be no unmet public transportation needs which could be reasonably met by expansion of existing transportation systems or by establishing new systems. 2. That a copy of this resolution be transmitted to the Kern County Council of Governments in conjunction with the filing of the claim; and the Kern County Council of Governments be requested to concur in these findings and grant the allocation of funds as specified on the Article 8 claim. o0o.
