A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD APPROVING AND ADOPTING A NEGATIVE
DECLARATION FOR THE PROPOSED DISPOSITION AND
DEVELOPMENT AGREEMENT BETWEEN THE BAKERSFIELD
REDEVELOPMENT AGENCY AND BELL TOWER ASSOCIATES
FOR THE SALE OF PROPERTY LOCATED IN THE DOWNTOWN
BAKERSFIELD REDEVELOPMENT PROJECT AREA AND THE
DEVELOPMENT OF SAID PROPERTY°
WHEREAS, the Bakersfield Redevelopment Agency ("Agency")
proposes to enter into a Disposition and Development Agreement
("Agreement") with Bell Tower Associates ("Developer") for the
sale of certain real property in the Project area and the develop-
ment of a multi-level parking structure; and
WHEREAS, the Economic Development/Redevelopment Department
of the City of Bakersfield prepared a Negative Declaration for
the proposed Agreement and development of a parking structure;
and
WHEREAS, said Negative Declaration was prepared and
completed in accordance with CEQA and State and local guidelines
and procedures; and
WHEREAS, notice of preparation of said Negative Declaration
was given by posting and publication as required by law; and
WHEREAS, a public hearing on said Negative Declaration
was jointly held and conducted by the Bakersfield City Council
and the Bakersfield Redevelopment Agency at a joint meeting
thereof on December 16, 1981; and
WHEREAS, all comments which have been received during
the review period on said Negative Declaration and the responses
thereto, together with the proposed Negative Declaration and
reasons to support the finding that the project will not have a
substantial adverse effect upon the environment, have been forwarded
to the City Council, and this Council has reviewed, considered
and evaluated the contents thereof.
NOW, THEREFORE, the Council of the City of Bakersfield
hereby resolves, finds and determines as follows:
1. That the above recitals are true and correct.
2. That the City Council has read, evaluated and con-
sidered the Negative Declaration, together with all applicable
supporting documents.
3. That the project designated as the Disposition and
Development Agreement and the development of a multi-level parking
structure will not have a significant adverse effect on the
environment.
4. That the Negative Declaration on the said project
is hereby approved and adopted.
5. That the project is approved.
6. That the Economic Development/Redevelopment Department
shall file with the Kern County Clerk a Notice of Determination as
required by the State EIR Guidelines and local rules and pro-
cedures.

I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at a
regular meeting thereof held on the 16tb day of December, 1981, by
the following vote:
